Our regulations for the transportation of hazardous liquids by pipeline require operators with 500 or more miles of regulated pipelines to establish a program for managing the integrity of pipelines that affect high consequence areas. The regulations require continual assessment and evaluation of pipeline integrity through inspection or testing, data integration and analysis, and follow-up remedial, preventive, and mitigative actions. This Final Rule extends those regulations to operators with less than 500 miles of regulated pipelines. We are taking this action because safety recommendations, statutory mandates, and accident analyses indicate that coordinated risk control measures are needed for public safety and environmental protection in addition to compliance with traditional safety standards. Broadening the coverage of the existing regulations will further enhance the protection of high consequence areas against the risk of pipeline failures.

RSPA is pilot testing a model that identifies areas unusually sensitive to environmental damage from a hazardous liquid pipeline release, commonly referred to as unusually sensitive areas (USAs). The USA model was created through a series of public workshops and the work of the American Petroleum Institute (API). RSPA and API will be working together on this pilot test. Other government agencies, environmental groups, and academia will be evaluating the final results of this pilot test. The pilot test will be conducted in three states: Texas, Louisiana, and California. The purpose of the pilot testing is to determine if the model can be used to identify and locate unusually sensitive drinking water and ecological resources using available data from government agencies and environmental organizations. The pilot test will also help evaluate the USA model, determine if the model identifies the majority of unusually sensitive drinking water and ecological resources, and the appropriateness and accessibility of environmental data to support the model. RSPA will publish for public comment the results of the pilot test, technical analysis, and the proposed USA model once the pilot test and analysis are complete.

This final rule provides that operators may not transport a hazardous liquid in a steel interstate pipeline constructed before January 8, 1971, a steel interstate offshore gathering line constructed before August 1, 1977, or a steel intrastate pipeline constructed before October 21, 1985, unless the pipeline has been pressure tested hydrostatically according to current standards or operates at 80 percent or less of a qualified prior test or operating pressure. In addition, this final rule creates a comparable requirement for carbon dioxide pipelines constructed before July 12, 1991, except for production field distribution lines in rural areas. The purpose of this final rule is to ensure that the affected pipelines have an adequate safety margin between their maximum operating pressure and test pressure. This safety margin is essential to prevention of particular kinds of pipeline accidents.

The final rule also disallowed the use of petroleum as a pressure test medium. Because the prohibition on petroleum as a test medium was not specifically proposed, RSPA indicated it would withdraw that prohibition if it received comments that the prohibition was not in the public interest. RSPA received comments objecting to the prohibition and is therefore withdrawing the prohibition and allowing the use of petroleum as a test medium under specified conditions.
