Whenever a Colorado utility engages in the provision or marketing of non-regulated
goods or services in Colorado that are not subject to Commission regulation, and the
Colorado utility’s name or logo is used in connection with the provision of such non-
regulated goods and services in Colorado, there must be conspicuous, clear, and
concise disclosure to prospective customers that such non-regulated goods and
services are not regulated by the Commission. Such disclosure to prospective
customers in Colorado shall be included in all Colorado advertising or marketing
materials, proposals, contracts, and bills for non-regulated goods and services,
regardless of whether the Colorado utility provides such non-regulated goods or
services in Colorado directly or through a division or affiliate.
