The following definitions apply to rules 4700 through 4707, unless a specific statute or
rule provides otherwise. In the event of a conflict between these definitions and a
statutory definition, the statutory definition shall apply.
(a) “Local government” means a county, a home rule or statutory city, a town, a
territorial charter city, or a city and county.
(b) “Local government action” means (1) any decision, in whole or in part, by a local
government which has the effect or result of denying a permit or application of a
utility that relates to the location, construction, or improvement of a major natural
gas facility or (2) a decision imposing requirements or conditions upon such
permit or application that will unreasonably impair the ability of the utility to
provide safe, reliable, and economical service to the public.
(c) “Local land use decision” means the decision of a local government within its
jurisdiction to plan for and regulate the use of land.
(d) “Major natural gas facility” is defined by § 29-20-108(3)(e), C.R.S., or by any
other applicable statute.
(e) “Power authority” means an authority created pursuant to § 29-1-204, C.R.S.
