Probable Cause: The National Transportation Safety Board determines that the probable cause of the propane gas explosion, fueled by an excavationcaused gas leak, in the basement of the Humberto Vidal, Inc., office building was the failure of San Juan Gas Company, Inc., (1) to oversee its employees’ actions to ensure timely identification and correction of unsafe conditions and strict adherence to operating practices and (2) to provide adequate training to employees. At the present, Mr. Torres Correa is working on this aspect with his 15 years of experience on the LPG Division and his knowledge on the program is going to be pointed to the correct direction. We are working to develop a functional program in conjunction with the OPS covering the administrative area and the operational functions. As part of this effort we add an additional inspector that in conjunction with Mr. Torres Correa give the appropriate continuity to the installation under the jurisdictional. Procedures for the inspector: Any inspectors have to take the entire course on Transportation Safety Institute. Inspector must develop procedures for scheduling when an inspection unit is to be inspected. The inspector must complete the standard inspection that consist 1.Review operator records 2.Review operator's plans 3.Review procedures and Program 4.Review OM and OQ Program 5.Review the emergency program 6.Checks the pipeline facilities: a)Corrosion control b)Pressure and regulators equipment c)Odorization d)Repaired and or active leaks e)Emergency valves Notifying an operator: Upon completion of an inspection, the operator must be notified of the results of the inspection. This notification shall consist of an exit interview with appropriate staff and written notice to the office and or authorized official identifying any noncompliance noted during the inspection. The operator shall be notified immediately of any hazardous or unsafe situation discovered during the inspection. Follow up activity: The Public Service Commission must conduct follow-up actions when noncompliance is discovered for ensuring that all noncompliance is corrected. However, the Public Service Commission must maintain a complete record of each noncompliance found. Records: The Public Service Commission must keep records of all pipeline safety inspections and follow-up activities. Inspection records should include the inspection dates, the operator/inspection unit, the name of the inspector, the location and type of facilities inspected, the name and titles of operator staff contacted at the inspection unit, the regulation sections checked for compliance, and the resulting evaluation conclusions. Follow-up records should include all correspondence or other contact between the Public Service Commission and the operator, the results of follow-up inspections, and other information necessary to demonstrate that the noncompliance has been corrected. Penalty: When a civil penalty is found, the inspector must make a letter to the Director and the director to the commissioner for conduct a draft resolution of the violation.
