Within 30 days after issuance of NOPV the respondent shall respond in one of the following ways:

(a) sign the consent order and return it with payment of any proposed penalty;

(b) submit a written explanation, information or other material in response to the allegations; or

(c) request an informal conference with department staff.

(d) Failure of the respondent to respond in accordance with subdivision (a), (b) or (c) of this section shall constitute a waiver of its right to contest the allegations in the NOPV and authorizes the commission, without further notice to the respondent, to find the facts to be as alleged in the NOPV and to issue a final order under section 753-6.8 of this Subpart.
