CPF No. 3-2002-5009M ORDER DIRECTING AMENDMENT On January 23-24,20}2,pursuant to 49 U.S.C. $ 60117, representatives of the Central and Eastern Regions, Office of Pipeline Safety (OPS), inspected Jayhawk Pipeline L.L.C.'s (Respondent's) integnty management progr.rm at Respondent's facility in McPherson, Kansas. As a result,of the inspection, the Central,Regiondl Director, OPS, issued to Respondent, by,letter:datedMay.22,2002, a Notice of Amendment,(NOA). The,NOA alleged inadequacies:rn ResPsndentfs: integrity management program and proposed to require amendment of Respondent's.pr,ogedures to comply with the requirements of a9 C,F,R. $ 195:452(b). . . .' i: : Respondent responded to the NOA by letter dated June 11,2002. Respondent did not contest the NOA and did not request a hearing, consequently Respondent waived its right to one. However, Respondent submitted amended integrity management program procedures to address the inadequacies cited in the NOA. The Central Region reviewed the amended procedures. In its Response letter, Respondent explained in detail the process it now uses to identifi pipeline segments that could affect high consequence areas. How€ver, the revised procedures Respondent submitted are swnmary in nature and do not adequately delineate this detailed process. Respondent's procedures need to fully incorporate the detailed models described in the Response letter. Accordingly, I find that Respondent's integrity management program procedures are inadequate to ensnre safe operation of its pipeline system. Pursuant to 49 U.S.C. $ 60108(a) and 49 C.F.R. 5190.237, Respondent is ordered to make the following changes to its integrity management program procedures: l. Amend its procedures to provide adequate technical justification for determining the extent of the buffer zone used to identiff pipeline segments that could affect high consequence areas by including a systematic, technically sound land flow analysis incorporating factors, such as topological gradients, that could stretch the spill pool footprint beyond that associated with uniform distribution. 2 2. Amend its procedures to provide adequate technical justification for determining the extent of the buffer zone used to identiff pipeline segments that could affect high consequence areas to account for longer range paths, such as minor steams and waterways, that can transport releases of commodity to a high consequence area. 3 . . Submit the amended procedures within 30 days following receipt ofthis Order Directing Amendment. Submit all procedures and technical justifications demonstrating compliance with this Order to the Director, Central Region, Office of Pipeline Safety, 901 Locust Street, Suite 462, Kansas City, MO 64106-2641. The Director, Central Region, OPS, may grant an extension of time to comply with any of the required items upon a request by the Respondent demonstrating good cause for an extension. Failure to comply with this Order Directing Amendment may result in the assessment of civil penalties of up to $25,000 per violation per day, or in the referral of the case for judicial enforcement.
