Docket Number: PHMSA-2018-0091 Respondent was assessed a civil penalty of $14,160 for three violations of the HMR when it offered for transportation, and transported, in commerce, a hazardous material (UN1263, Paint, 3, PG II), in an unauthorized non-specification packaging, when specification packaging is required; when it offered a limited quantity of a compressed gas in a metal container for the purpose of propelling a non-poisonous material, without first heating the aerosol can in a hot water bath such that the internal pressure reaches that which would be reached at 55º C (131º F); and it failed to provide a proper hazardous materials shipping paper as prescribed by 49 C.F.R. § 172.200.
