Docket Number: PHMSA-2023-0031 Respondent was assessed a civil penalty of $31,335 for five violations of the HMR when it offered for transportation, in commerce, a hazardous material (UN05057, Signals, Smoke, 1.4S), without shipping papers, package markings, labels, and placards, where required; offered for transportation, in commerce, hazardous materials (UN0336, Fireworks, Smoke, 1.4G), and (UN05057, Signals, Smoke, 1.4S), in an unauthorized non-UN standard or non-specification packaging; offered for transportation, in commerce, hazardous materials (UN0336, Fireworks, Smoke, 1.4G), and (UN05057, Signals, Smoke, 1.4S), while failing to provide initial training to hazmat employees (general awareness, function-specific, safety, and security awareness); offered for transportation, in commerce, a hazardous material while using an incorrect UN ID number that does not change the response information on a shipping paper; and offered for transportation, in commerce, a hazardous material while marking a package with an improper shipping name that does not change the response information.
