Dear Captain Bugg:
This responds to your February 12, 2007 letter requesting clarification on the
applicability of § 172.328(d) of the Hazardous Materials Regulations (HMR; 49 CFR
equipped with remote emergency closures, or only to specification cargo tanks that are
Parts 171-180). Specifically, you ask if this section applies to any cargo tank that is
required to have self-closing internal stop valves.
Section 172.328(d) requires that after October 3, 2005, each on-vehicle manually-
activated remote shutoff device for closure of the internal self-closing stop valve must be
identified by marking "Emergency Shutoff" in letters at least 0.75 inches in height, in a
color that contrasts with its background, and located in an area immediately adjacent to
remote emergency closures. These cargo tanks include MC 330 and MC 331
the means of closure. This requirement applies to any cargo tank that is equipped with
specification cargo tanks under Part 180, Subpart E, as well as non specification cargo
tanks carrying liquefied petroleum gas in accordance with provisions in § 173.315(k).
