Dear Mr. Guttemberg:
This responds to your letter regarding the requirements governing the transportation of
radioactive materials and information on the process of starting a transportation company to
carry hazardous materials in commerce.
The Hazardous Materials Regulations (HMR) is found in Title 49, Code of Federal
Regulations, Parts 100-1 85. As provided in 49 CFR 171.1, the HMR apply to any
department, agency or instrumentality that transports or causes to be transported or shipped
hazardous materials in interstate, intrastate, and foreign commerce, by all modes of
transportation (i.e., highway, rail, air, and vessel). The HMR contain classification,
packaging, shipping papers, labeling, placarding, emergency response information, training,
registration, security awareness, and security plans requirements. The HMR can be
accessed through our Web Page site: http:llwww.phmsa.dot.~ov/hazmat/re~s.
Specific requirements applicable to the shipment of radioactive materials are found in
Subpart I of Part 173 of the HMR. The HMR also contain modal requirements applicable
to rail, air, vessel and highway carriers in Parts 174, 175, 176 and 177, respectively. In
addition, the regulations under Parts 390-397 of the Federal Motor Camer Safety
Administration (FMCSA) apply to hazardous materials shipped by highway.

Maryland. I need proper information covering the transportation of radiation
