No.: 12-0257 Dear Mr. Messer: This responds to your November 13, 2012letter requesting clarification of the Hazardous -----·Materials Regulations (HMR; 49 CFR Parts 171-180) applicable to shipping papers. You state that you have shipping papers with multiple pages that are marked in accordance with § 172.201( c). When hazardous materials are not listed on the first page, but on a continuation page, the hazardous materials are always indicated in accordance with § 172.201( a)(1 )(iii) with an X in the hazardous materials column. Any shipping papers for a load that contains hazardous materials are placed on top of the stack of shipping papers which are accessible in accordance with§ 177.817(e). You ask if§ 177.817(e) requires the shipping papers containing the hazardous materials to appear first, or is the intention to place the individual pages of the shipping paper containing hazardous materials on top? Section 177.817(e)(l) requires that the driver and carrier to clearly distinguish a shipping paper for shipments that contain hazardous materials. If other shipping papers are carried, the shipping paper containing hazardous materials must be distinguished by either distinctly "tabbing" the shipping paper or having it appear first. It is the opinion of this Office that having the shipping paper containing a hazardous material first in the stack as you suggested would satisfy this requirement. You should note that this requirement is applicable to both the carrier and driver. I trust this satisfies your inquiry. Please contact us if we can be of further assistance. Further, 172.201( c) states that a shipping paper "may consist of more than one page, if each page is consecutively numbered and the first page bears a notation specifying the total number of pages included in the shipping paper." Part 177.817(e) states "A driver of a motor vehicle containing hazardous material ... sha/1: (1)Ciearly distinguish the shipping paper, if it is carried with other shipping papers or other papers of any kind, by either distinctively tabbing it or by having it appear first; .. " We often have bills of lading that contain multiple pages which are marked in accordance with 172.201(c). There are times when the hazardous materials are not listed on the first page, but on a continuation page (for example, page 3 of 6). The hazardous materials are always indicated as described in 172.201(a)(1)(iii), with an X in the HM column. Any bills of lading for the load that contain hazardous materials are on the top of the stack of bills which are readily accessible (in compliance with 177.817(e)). It is our understanding that 177.817(e) is referring to the whole shipping paper (including continuation pages) that must appear first. Are we in compliance by having the 6-page document (with hazardous materials on page 3) on the top of the stack of other bills of lading? Or is it the intent of the regulation for the 6-page document to be out of order so Page 3 (with the hazardous material listed) is on top? See above attachment for reference.
