Dear Mr. Pearson:
On June 7, 2016, Magellan Midstream Partners, L.P. (Magellan) wrote to the Pipeline and
Hazardous Materials Safety Administration (PHMSA) requesting a special permit to waive
compliance with the pipeline safety regulations in 49 Code of Federal Regulations (CFR)
195.432 that require internal inspection intervals for in-service breakout tanks. Magellan 's
special permit request asks PHMSA to allow extended inspection intervals of 49 CFR 195.432
for Magellan ' s existing atmospheric aboveground breakout storage tanks (breakout storage tanks
or tanks).
PHMSA is granting this special permit (enclosed) to Magellan to allow extended inspection
intervals for Magellan' s existing breakout storage tanks as listed in Appendices A and B of the
special permit. This special permit provides relief from the Federal pipeline safety regulations
for Magellan 's existing breakout storage tanks, and requires Magellan to comply with certain
conditions and limitations designed to maintain pipeline safety where the tanks inspection
intervals have been extended.
The Magellan existing atmospheric aboveground breakout storage tanks and associated facilities
include 493 breakout storage tanks at 81locations in 14 states. The breakout storage tank
facilities are in industrial properties and consist of storage tanks, buildings, pump stations,
valves, facility pipe, roads, and other aboveground appurtenances. PHMSA grants this special
permit based on the permit conditions and the findings set forth in the "Analysis and Findings"
and "Final Environmental Assessment and Finding ofNo Significant Impact" documents, which
can be read in their entirety in Docket No. PHMSA-2016-0072 at www.Regulations.gov.

Grant of Special Permit:
By this order, subject to the terms and conditions set forth below, the Pipeline and Hazardous
Materials Safety Administration (PHMSA) Office of Pipeline Safety (OPS)1 grants a special
permit (PHMSA-2016-0072) to Magellan Midstream Partners, L.P. and its subsidiaries
(collectively "Magellan"f for extending the internal inspection schedule requirements in 49
Code ofFederal Regulations (CFR) 195.432 for Magellan' s existing atmospheric above ground
breakout storage tanks (breakout storage tanks or tanks). This special permit requires Magellan
to implement inspection intervals based on the evaluation of an established minimum safe floor
thickness, previous inspection results, corrosion rates, and defined likelihood and consequence
factors for existing atmospheric above ground breakout storage tanks, as described in this special
permit.

The Magellan above ground breakout storage tanks and associated facilities are at 81 locations in
14 states. These facilities are industrial properties consisting of storage tanks, buildings, pump
stations, valves, facility pipe, roads, and other above ground appurtenances.
Based on the determination in the Special Permit Analysis and Findings (available in the docket)
that this special permit, with conditions, will maintain pipeline safety, PHMSA OPS hereby
grants special permit PHMSA-2016-0072 as follows:
I. Special Permit Tanks:
493 tanks located in the States of Colorado, Connecticut, Illinois, Iowa, Kansas, Minnesota,
Missouri, Nebraska, North Dakota, Oklahoma, South Dakota, Texas, Wisconsin, and
Wyoming
On the condition that Magellan complies with the terms and conditions set forth below, this
special permit waives compliance from 49 CFR 195.432 for the inspection intervals of 493
existing atmospheric above ground breakout storage tank as described below and in Appendix A
-Magellan Breakout Storage Tanks: Location- State, Facility Name, County, and Number of
Tanks and Appendix B- Secondary Dike Containment of this special permit.
• Special permit tanks- are defined as any of the 493-existing atmospheric above ground
breakout storage tank described in Appendix A of this special permit.
PHMSA hereby grants this special permit for the Magellan special permit tanks based on the
findings set forth in the "Special Permit Analysis and Findings" and the "Final Environmental
Assessment and Findings of No Significant Impact" documents, which both can be read in their
entirety in Docket No. PHMSA-2016-0072 in the Federal Docket Management System (FDMS)
located on the internet at www.Regulations.gov.
II. Conditions:
PHMSA OPS grants this special permit for the special permit tanks subject to implementation of
the following conditions:

1. Internal Inspection Schedule: For the atmospheric above ground breakout storage tanks
(special permit tanks), Magellan must conduct a transitional staged internal inspection
schedule as follows:
a. Special Permit Tanks Last Inspected Before 1995: Inspect within 30 years of the
previous internal inspection date (25 tanks remain to be inspected as of May 20 17).
b. Special Permit Tanks Last Inspected Between 1995 and 2009: Inspect within 28
years of the previous internal inspection date (333 tanks remain to be inspected as of
May 2017).
c. Special Permit Tanks Last Inspected Between 2010 and 2013: Inspect within 25
years of the previous internal inspection date ( 13 5 tanks remain to be inspected as of
May 2017).
2. Special Permit Tank Inspections and Monitoring: Magellan must develop procedures,
conduct, document, and maintain:
a. Internal inspections of the described existing special permit tanks that are consistent
with the special permit and as required by 49 CFR 195.432;3'4
b. Visual inspections of the special permit tanks and their secondary containment dikes
are required once per manned shift and at least weekly for unmanned locations.
Magellan personnel must inspect the tank farm (including tanks and containment) for
the integrity of the containment dikes or secondary containment, evidence of product
releases, trash and debris, uncontrolled erosion, unusual sounds from operating
equipment, damage, vibration, misalignment, and security;
3 If PHMSA adopts a revised edition of API Standard 653 other than the 3rd edition into 49 CFR Part 195, Magellan
must notify PHMSA within 60 days of the effective date of the adopted revised standard regarding the option to
continue compliance under this special permit with the existing API Standard 653 3rd edition or comply with the
updated edition under 49 CFR Section 195.3. However, if the revised adopted edition of API Standard 653
continues to exclude alternate inspection intervals, the conditions of the special permit will remain in effect for the
determination of inspection intervals.
4 Industry standards "incorporated by reference" are listed in 49 CFR 195.3. If PHMSA adopts a revised edition of
a referenced standard such as API, NACE International (NACE) or ASME standards into 49 CFR Part 195, the
referenced requirements of those revised standards are automatically incorporated into these special permit
conditions unless noted otherwise, except as noted in Footnote 3 above.

c. Continuous monitoring of the special permit tank levels through the supervisory
control and data acquisition (SCADA) system; and
d. Semi-annual, not to exceed 7 lh months, static tank trending for 12 continuous hours
to verify the integrity of the special permit tanks. Magellan must isolate the special
permit tanks from inbound or outbound products movements. The special permit
tank level must be at least half full . Once isolated, the breakout storage tank must sit
idle for a minimum of 12 continuous hours. During the static 12 hours, the special
permit tank product level must be reviewed for product level discrepancies.
3. Re-evaluation Inspection Intervals: Magellan must develop procedures and conduct
transitional staged internal inspections of the special permit tanks and must readjust
inspection schedules of future special permit tank inspections as follows:
a. Inspection schedules of future special permit tank inspections must be based upon
past inspection findings at a special permit tank site location or similar vintage
construction types at other tank locations in this proposed special permit;
b. Re-evaluation intervals must be shortened when special permit tank inspection
findings demonstrate inspection intervals were not sufficiently conservative to
maintain established minimum safe floor and wall thicknesses, and material corrosion
rates;
c. Transitional staged internal special permit tank inspection intervals must be modified
if a breakout storage tank of similar service indicates a more conservative internal
inspection interval should apply; and
d. Special permit tanks of similar service must be identified by having been constructed
during, or within six (6) months of, the same year, under the same conditions, with
similar foundations and store similar products.

4. 5. Annual Report to PHMSA: Annually,
5 after issuance of this special permit, Magellan must
submit an annual special permit tank integrity report6 to the PHMSA Central, Eastern,
Southwest and Western Region Directors with copies to the Deputy Associate Administrator,
PHMSA Field Operations; Deputy Associate Administrator, PHMSA Policy and Programs;
Director, PHMSA Engineering and Research Division; and Director, PHMSA Standards and
Rulemaking Division.
7 The annual integrity report must summarize for the special permit
tanks the following and any other significant integrity threats as follows :
a. Any leakage of special permit tanks including location, leakage amount, repairs
taken, and impact of any other tanks inspection schedule or integrity;
b. Any inspection findings that caused a readjustment of inspection schedules and the
special permit tanks involved in the reschedule of inspection interval;
c. Any secondary containment integrity issues found or remediated that would have
impacted containment in the case of a leak or failure of the special permit tank;
d. Any leaks or failures found through the continuous monitoring of tank levels through
the SCAD A system (Condition 2.c) or the semi-annual static tank trending for 12
continuous hours (Condition 2.d); and
e. Identification of special permit tanks inspected during the past year and planned
inspections for the next two (2) years.
Tank Integrity Program: Under the proposed special permit, Magellan must continue use
of its existing documented Tank Integrity Program (Magellan procedure 7.1 0-ADM-001 Tank
5 Annual reports must be received by PHMSA by the last day of the month in which the special permit is dated.
For example, the annual report for a special permit dated January 2018, must be received by PHMSA no later than
January 31 , each year beginning in 2019.
6 Magellan must submit a copy of each Magellan annual pipeline integrity report on the PHMSA docket, PHMSA-
20 16-0072, at regulations.gov.
7 Magellan must also send a copy to the PHMSA Director of State Programs and the appropriate state authorities of
the states that have interstate or intrastate agent agreements with PHMSA in states where the breakout storage
tanks are located.

6. Integrity Program, revision date 01 /01118)8 during the transitional staged internal special
permit tank inspection period (Condition 1 ).
Certification: A Magellan senior executive officer, vice president or higher must certify in
writing the following:
a. Magellan has developed a written manual of operating and maintenance (O&M)
procedures required by 49 CFR 195.402 and 195.432, and all requirements ofthis
special permit for the special permit tanks; and
b. Magellan has implemented all special permit conditions, 49 CFR 195.402 and
195.432, as required by this specia\ permit for the special permit tanks.
Magellan must send the certifications required in Condition 6.a and 6.b with completion
date, compliance documentation summary, and the required senior executive signature and
date of signature to the PHMSA Associate Administrator for Pipeline Safety with copies to
the Deputy Associate Administrator, PHMSA Field Operations; Deputy Associate
Administrator, PHMSA Policy and Programs; PHMSA Central, Eastern, Southwest, and
Western Region Directors; Director, PHMSA Standards and Rulemaking Division; Director,
PHMSA Engineering and Research Division9
; and to the Federal Register Docket (PHMSA-
2016-0072) at www.Regulations.gov within one (1) year ofthe effective date ofthis special
permit.
III. Limitations:
PHMSA issues this special permit subject to the following limitations:
1) PHMSA has the sole authority to make all determinations on whether Magellan has complied
with the specified conditions of this special permit.
8 Any updates to Magellan procedure 7.10-ADM-001 Tank Integrity Program, revision dated 01 /01/18, that affect
the inspections, remediation and monitoring of the special permit tanks must be submitted by Magellan to
PHMSA 's Deputy Associate Administrator, PHMSA Field Operations, for review. Magellan must receive a "no
objection" letter from PHMSA prior to any updated procedure implementation on the special permit tanks.
9 Magellan must also send a copy to the PHMSA Director of State Programs and the appropriate state authorities of
the states that have interstate or intrastate agent agreements with PHMSA in states where the breakout storage
tanks are located.

2) Failure to submit the certifications required by Condition 6 within the time frames specified
may result in revocation of this special permit.
3) PHMSA may revoke, suspend, or modify this special permit based on any finding listed in 49
CFR 190.341 (h)(l) and require Magellan to comply with the regulatory requirements in 49
CFR 195.432 and an amended Condition !-Internal Inspection Schedule. As provided in 49
U.S.C. Chapter 601 and 49 CFR Part 190, PHMSA may also issue an enforcement action for
failure to comply with this special permit. Any work plans and associated schedules will be
automatically incorporated into this special permit and are enforceable in the same manner.
4) Should PHMSA revoke, suspend, or modify this special permit based on any finding listed in
49 CFR 190.341 (h)(l ), PHMSA will notify Magellan in writing of the proposed action and
provide Magellan an opportunity to show cause why the action should not be taken. In
accordance with 49 CFR 190.341 (h)(2)(i), Magellan may provide a written response within
30 days of the notice showing why the proposed action should not be taken. However, if
necessary to avoid the risk of significant harm to persons, property, or the environment,
PHMSA will declare the proposed action (revocation, suspension, or modification)
immediately effective, in accordance with 49 CFR 190.341 (h)(3).
5) The terms and conditions of any corrective action order, compliance order, or other order
applicable to a pipeline facility covered by this special permit will take precedence over the
terms ofthis special permit in accordance with 49 CFR 190.341(h)(4).
6) Magellan may seek reconsideration of a decision made pursuant to 49 CFR 190.341 (h) by
submitting a petition to the Associate Administrator of Pipeline Safety, in accordance with 49
CFR 190.341 (i). The Associate Administrator's decision made pursuant to 49 CFR
190.341 (i) constitutes final administrative action. All final administrative actions are subject
to juridical review under 49 U.S.C. 60119.
7) If Magellan sells, merges, transfers, or otherwise disposes of the assets known as the special
permit tanks, Magellan must provide PHMSA with written notice of the change within 30
days of the consummation date. In the event of such transfer, PHMSA reserves the right to
revoke, suspend, or modify the special permit if the transfer constitutes a material change in

conditions or circumstances pursuant to 49 CFR 190.341 (h)(l )(ii) or any other circumstances
listed under 49 CFR 190.341(h)(l) .

8) PHMSA grants this special permit to a term of no more than 20 years from the issuance date.

PHMSA received approval from the Railroad Commission of Texas pipeline office, Director-
Stephanie Weidman on January 26, 2018 to include the Magellan intrastate hazardous pipeline facility
breakout tanks noted in Appendix B above as part of the special permit. Magellan intrastate hazardous
liquid pipeline facility breakout tanks in the state of Connecticut are inspected by PHMSA and are a part
of this special permit as noted in Appendix B above.

Purpose:
The Pipeline and Hazardous Materials Safety Administration (PHMSA) Office of Pipeline
Safety (OPS)' provides this information to describe the facts of the subject special permit
application submitted by Magellan Midstream Partners, L.P. and its subsidiaries (collectively
"Magellan")? to discuss any relevant public comments received with respect to the application, to
present the engineering/safety analysis of the special permit application, and to make findings
regarding whether the requested special permit should be granted and if so under what
conditions. Magellan requested that PHMSA waive compliance from 49 Code of Federal
Regulations (CFR) 195.432 by extending the internal inspection schedule requirements for 493
of Magellan's existing atmospheric above ground breakout storage tanks (breakout storage tanks
or tanks).

Pipeline System Affected:
Magellan's special permit request applies to 493 tanks and associated facilities at 81 sites located
in the states of Colorado, Connecticut, Illinois, Iowa, Kansas, Minnesota, Missouri, Nebraska,
North Dakota, Oklahoma, South Dakota, Texas, Wisconsin, and Wyoming. The facilities are
industrial properties consisting of storage tanks, buildings, pump stations, valves, facility pipe,
roads, and other above ground appurtenances.
Special Permit Request:
Magellan submitted an application to PHMSA on June 7, 2016, for a special permit seeking
relief from the Federal pipeline safety regulations in 49 CFR 195.432 for extended inspection
intervals of 493 existing atmospheric above ground breakout storage tank as described below and
in Appendix A - Magellan Breakout Storage Tanks: Location - State, Facility Name, County,
and Number of Tanks.
• Special permit tanks - are defined as any of the 493 existing atmospheric above ground
breakout storage tank described in Appendix A of this special permit.
The special permit requires Magellan to implement inspection intervals based on the evaluation
of an established minimum safe floor thickness, previous inspection results, corrosion rates, and
defined likelihood and consequence factors for existing atmospheric above ground breakout
storage tanks, as described in this special permit.
Public Notice:
On August 15, 2017, PHMSA published the special permit request in the Federal Register (82
FR 38758) and the public comment period ended on October 16, 2017. The special permit
application from Magellan, environmental assessment, and special permit conditions are
available in Docket No. PHMSA-2016-0072 at: www.regulations.gov.
PHMSA received no stakeholder comments on the proposed Magellan special permit.
Analysis:
PHMSA developed the special conditions to achieve safety by decreasing the likelihood of a
release of hazardous liquid by the special permit tanks and that migrates outside the containment
dikes.

• Special Permit Tanks Last Inspected Before 1995: Inspect within 30 years of the
previous internal inspection date (25 tanks remain to be inspected as of May 2017);
• Special Permit Tanks Last Inspected Between 1995 and 2009: Inspect within 28
years of the previous internal inspection date (333 tanks remain to be inspected as
of May 2017); and
• Special Permit Tanks Last Inspected Between 2010 and 2013: Inspect within 25
years of the previous internal inspection date (135 tanks remain to be inspected as
of May 2017).
• Develop and Implement Procedures and Conduct and Document;
• Internal inspections of the special permit tanks;
• Visual inspections of the special permit tanks and their secondary containment
dikes;
• Continuous monitoring of the special permit tank levels through the supervisory
control and data acquisition (SCADA) system; and
• Semi-annual, not to exceed 7 ½ months, static tank trending for 12 continuous
hours to verify the integrity of the special permit tanks.
• Re-evaluation Inspection Intervals:
Inspection schedules of future special permit tank inspections must be based upon
past inspection findings at a special permit tank site location or similar vintage
construction types at other tank locations in this proposed special permit;
Re-evaluation intervals must be shortened when special permit tank inspection
findings demonstrate inspection intervals were not sufficiently conservative to
maintain established minimum safe floor and wall thicknesses, and material
corrosion rates;

• Transitional staged internal special permit tank inspection intervals must be
modified if a breakout storage tank of similar service indicates a more conservative
internal inspection interval should apply; and
• Special permit tanks of similar service must be identified by having been
constructed during, or within six (6) months of, the same year, under the same
conditions, with similar foundations and store similar products.
• Annual Report to PHMSA:
• Any leakage of special permit tanks including location, leakage amount, repairs
taken, and impact of any other tanks inspection schedule or integrity;
• Any inspection findings that caused a readjustment of inspection schedules and the
special permit tanks involved in the reschedule of inspection interval;
• Any secondary containment integrity issues found or remediated that would have
impacted containment in the case of a leak or failure of the special permit tank;
• Any leaks or failures found through the continuous monitoring of tank levels
through the SCADA system or the semi-annual static tank trending for 12
continuous hours; and
• Identification of special permit tanks inspected during the past year and planned
inspections for the next two (2) years.
• Tank Integrity Program:
• Continue use of its existing documented Tank Integrity Program (Magellan
procedure 7.10-ADM-001 Tank Integrity Program, revision date 01/01/18) during
the transitional staged internal special permit tank inspection period.
• Certification: A Magellan senior executive officer, vice president or higher must certify
in writing the following:
Magellan has developed a written manual of operating and maintenance (O&M)
procedures required by 49 CFR 195.402 and 195.432, and all requirements of this
special permit for the special permit tanks; and
Magellan has implemented all special permit conditions, 49 CFR 195.402 and
Special Permit: PHMSA-2016 - 0072 - Magellan Midstream Partners, L.P.

195.432, as required by this special permit for the special permit tanks.
• Limitations:
• The special permit is for an interval of 20 years;
• PHMSA may revoke, suspend or modify the Magellan special permit based on
any finding listed in 49 CFR 190.341(h)(1) and require Magellan to comply with
the regulatory requirements in 49 CFR 195.432;
• As provided in 49 U.S.C. Chapter 601 and 49 CFR Part 190, PHMSA may also
issue an enforcement action for failure to comply with the special permit; and
• Any work plans and associated schedules must be automatically incorporated into
the Magellan special permit and are enforceable in the same manner.
Operational Enforcement History - 2007 through December 31, 2017:
Since the beginning of 2007 through December 31, 2017, Magellan was cited in 40 enforcement
cases with a total of $1,067,680 in collected penalties. PHMSA initiated eight (8) Notices of
Amendments, ten (10) Notices of Probable Violations, nineteen (19) Warning Letters, and three
(3) Corrective Action Orders against Magellan and subsidiaries.

PHMSA finds there are no current enforcement cases that impede going forward with the
granting of this special permit request by Magellan.
The special permit application from Magellan, environmental assessment, and special permit are
available in Docket No. PHMSA-2016-0072 at: www.regulations.gov.
PHMSA has determined that imposing the conditions and limitations summarized in this
document and detailed in the special permit will ensure that granting the special permit for an
extended inspection interval for the special permit tanks will be consistent with safety.
Findings:
Based on the information submitted by Magellan and PHMSA's analysis of technical,
operational and safety issues, and given the conditions that will be imposed in the special permit,
PHMSA finds that granting this special permit to Magellan to operate 493 special permit tanks
located at 81 sites in the states of Colorado, Connecticut, Illinois, Iowa, Kansas, Minnesota,
Missouri, Nebraska, North Dakota, Oklahoma, South Dakota, Texas, Wisconsin, and Wyoming
with an extended inspection interval for 20-years would not be inconsistent with pipeline safety.

Background
The National Environmental Policy Act (NEPA), 42 United States Code (USC) §§ 4321 -
4375, Council on Environmental Quality regulations, 40 Code of Federal Regulations
(C.F.R. or CFR) §§ 1500-1508, and U.S. Department of Transportation (DOT) Order
5610.1C, requires the Pipeline and Hazardous Materials Safety Administration (PHMSA)
Office of Pipeline Safety (OPS)' analyze a proposed action to determine whether the action
will have a significant impact on the human environment. PHMSA analyzes special permit
requests for potential risks to public safety and the environment that could result from our
decision to grant, grant with additional conditions, or deny the request. As part of this

analysis, PHMSA evaluates whether a special permit would impact the likelihood or
consequence of a pipeline system failure when compared to operation of the pipeline
system in full compliance with the Pipeline Safety Regulations.
The purpose of this final environmental assessment is to comply with the National
Environmental Policy Act for Magellan Midstream Partners, L.P. and its subsidiaries'
(collectively "Magellan")? application of a special permit to lengthen the inspection
interval of breakout tanks as required in 49 CFR 195.432. This final environmental
assessment is intended to specifically analyze any environmental impact associated with
the proposed waiver of certain Pipeline Safety Regulations found in 49 CFR 195.432. This
final environmental assessment is prepared by the U.S. Department of Transportation,
Pipeline and Hazardous Materials Safety Administration to analyze the special permit
request in accordance with 49 CFR 190.341.
PHMSA may grant the special permit request with additional conditions or deny the
request. PHMSA developed this environmental assessment to determine the effects of our
decision, if any, on the environment.
Pursuant to 49 USC § 60118(c) and 49 CFR 190.341, PHMSA may only grant special
permit requests that are not inconsistent with pipeline safety. PHMSA will impose
conditions in the special permit if we conclude they are necessary for safety or to prevent
the release of hazardous liquids. If PHMSA determines that a special permit would be
inconsistent with pipeline safety or is not justified, the application will be denied.

Site Description
The assets subject to the special permit are existing atmospheric aboveground breakout
storage tanks located inside secondary containment dikes within active, maintained
facilities. Aerial photos (Attachment 1: Aerial View of the Tank Locations) have been
provided to depict the environment near each facility where existing active atmospheric
aboveground breakout storage tanks are located
The activity associated with this special permit relates to maintenance. This special permit
does not apply to the expansion of the existing facilities beyond their current dimensions.

A list of the atmospheric aboveground breakout storage tanks with the location, county,
and state of each tank included in the special permit request are described in Attachment
2: Magellan Breakout Storage Tanks Included in the Special Permit Request, Number of
Tanks, Facility Name, County and State.
The pipeline facilities included in the special permit are limited to existing atmospheric
breakout storage tanks that are currently operated and maintained aboveground within
secondary containment dikes at active, maintained Magellan storage facilities. The
existing Magellan atmospheric aboveground breakout storage tanks are used to facilitate
the storage and distribution of crude oil and refined products such as gasoline, diesel fuel,
and aviation fuel. A list of the atmospheric aboveground breakout storage tanks with each
tank's size, secondary containment capacity, location, county, and state of each tank
included in the special permit request are described in Attachment 2.
Attachment 1 includes maps of the existing atmospheric aboveground storage tank
facilities relative to the local surroundings. The atmospheric aboveground breakout storage
tanks included in the special permit are regulated under 49 CFR 195.432.
These facilities are industrial properties consisting of storage tanks, buildings, pump
stations, valves, facility pipe, roads, and other aboveground appurtenances.
The special permit will apply to existing atmospheric aboveground breakout tank storage
facilities located at 81 locations in 14 states (Colorado, Connecticut, Illinois, Iowa, Kansas,
Minnesota, Missouri, Nebraska, North Dakota, Oklahoma, South Dakota, Texas, Wisconsin, and
Wyoming). There are 67 facilities located in a high consequence area ("HCA") or a
location that could affect an HCA in accordance to 49 CFR 195.450 and therefore are
included in the Magellan Integrity Management Program. Attachment 2 describes the

specific existing atmospheric aboveground breakout tank storage facilities that are in a
HCA or could affect a HCA
Ill.
Purpose and Need
The purpose of the special permit is to lengthen the interval between internal inspections of
Magellan's existing atmospheric aboveground breakout storage tanks.* The special permit
will not authorize the expansion or construction of new pipeline infrastructure, and any
new tanks constructed would be outside the scope of this special permit. On January 5,
2015, PHMSA issued the rulemaking, "Periodic Updates of Regulatory References to
Technical Standards and Miscellaneous Amendments" (2015 Standards Update Rule)
(January 5, 2015 80 FR 168). This rulemaking included the amendment to 49 CFR
195.432 to eliminate incorporation by reference Section 6.4.3 of the Third Edition of
American Petroleum Institute (API") Standard 653, "Tank Inspection, Repair, Alteration,
and Reconstruction", which allowed operators to set risk-based internal inspection
intervals. The updated version of 49 CFR § 195.432 adopts Section 6.4.2 of API Standard
653, 3" Edition.
The Magellan Tank Integrity Program establishes subsequent inspection intervals through
the evaluation of an established minimum safe floor thickness, previous inspection results,
corrosion rates, and defined likelihood and consequence factors.
Describe the purpose of the requested special permit. What will it allow the
operator to do that it could not do under the existing regulations?
The special permit provides a variance from the requirements of 49 CFR 195.432 for the
atmospheric aboveground breakout storage tanks (breakout tanks) and allows Magellan to

Magellan must conduct subsequent internal inspections of the atmospheric above ground
breakout storage tanks described above as required by 49 CFR 195.432. The special
permit granted to Magellan does not give relief from the requirements of 49 CFR 195.432
for its breakout tanks inspected in 2014 to present, which will be within 20 years of the
previous internal inspection date as required by the January 5, 2015, amended
requirements of 49 CFR 195.432. Under the special permit, Magellan must continue use
of its existing documented Tank Integrity Program during the transitional staged internal
inspection period.

The need for the requested special permit is based on the 2015 Standards Update Rule
which removed Section 6.4.3 of API Standard 653 and replaced it with Section 6.4.2. of
API Standard 653. At the time the rulemaking was published, compliance with this
standard significantly accelerated the internal inspection intervals of over 550 of
Magellan's 800 breakout tanks. Additionally, the 2015 Standards Update Rule revised
49 CFR 195.432 and required Magellan to perform internal inspections of approximately
100 tanks by January 5, 2017.

Due to the number of atmospheric aboveground breakout storage tanks impacted under the
existing regulations, Magellan expects it would experience significant logistical challenges
in securing additional project personnel, qualified contractors, and reputable inspection
services to oversee the accelerated tank internal inspections.
Compliance with 49 CFR 195.432 effectively requires a significant shift in resources from
Magellan's elective higher risk reduction programs due to reprioritization of limited
specialized resources towards accelerated breakout tank internal inspections.
PHMSA's approval of the special permit allows Magellan to perform internal breakout
tank inspections using a transitional staged internal inspection schedule which would
minimize reprioritization of resources away from elective high risk reduction programs.
Granting this special permit avoids possible service disruptions of oil and petroleum
products in the markets serviced by Magellan terminals.
IV.
Alternatives
• Alternative 1: "No Action" Alternative
In this alternative, the special permit would be denied, and Magellan would be required to
fully comply with the current version of 49 CFR 195.432.
Based on the number of tanks involved, Magellan expects significant logistical
challenges to secure additional project personnel, qualified contractors, and reputable
inspection services to oversee the accelerated tank internal inspections.
Compliance with 49 CFR 195.432 would effectively require a significant shift in
resources from Magellan's elective higher risk reduction programs due to reprioritization
of resources.
Alternative 2: Selected Alternative
PHMSA will issue a special permit to provide a variance from the requirements of
49 CFR 195.432 to Magellan to perform breakout tank internal inspections through the
use of the following transitional staged internal inspection schedule:

Under the proposed special permit, Magellan must continue use of its existing
documented Tank Integrity Program during the transitional staged internal inspection
period.
Magellan's Tank Integrity Program incorporates the use of daily shift visual inspections 5
of the break out tanks and their secondary containment dikes, continuous monitoring of
tank levels through the Supervisory Control and Data Acquisition (SCADA) system, and
semi-annual static tank trending for 12 continuous hours.
5 Magellan procedure 9.01-ADM-034 is required once per manned shift (at least weekly for unmanned
locations). Per procedure, Magellan personnel inspect the tank farm (including tanks and containment)
for the integrity of dikes or secondary containment, evidence of releases, trash and debris, uncontrolled
erosion, unusual sounds from operating equipment, damage, vibration, misalignment, and security.
• Magellan procedure 9.01-ADM-022 is a static tank check performed semi-annually, not to exceed 7½
months to verify the integrity of the tank. Magellan isolates the tank from inbound or outbound
products movements. The target tank level is at least half full. Once isolated, the tank will sit idle for a
minimum of 12 continuous hours. During the static 12 hours the tank product level is reviewed for
product level discrepancies.

• Below are the Special Permit Conditions:
Magellan requested that PHMSA issue a special permit that would provide a variance
from the requirements of 49 CFR 195.432 for the inspection intervals of the atmospheric
aboveground breakout storage tanks. The special permit is subject to Magellan
implementing of the following conditions:
Internal Inspection Schedule: For the atmospheric aboveground breakout storage tanks
(special permit tanks), Magellan must conduct a transitional staged internal inspection
schedule as follows:
a. Special Permit Tanks Last Inspected Before 1995: Inspect within 30 years of the
previous internal inspection date (25 tanks remain to be inspected as of May 2017).
b. Special Permit Tanks Last Inspected Between 1995 and 2009: Inspect within 28
years of the previous internal inspection date (333 tanks remain to be inspected as of
May 2017).
c. Special Permit Tanks Last Inspected Between 2010 and 2013: Inspect within 25
years of the previous internal inspection date (135 tanks remain to be inspected as of
May 2017).
2. Special Permit Tank Inspections and Monitoring: Magellan must develop procedures,
conduct, document, and maintain:

b.
Visual inspections of the special permit tanks and their secondary containment dikes
are required once per manned shift and at least weekly for unmanned locations.
Magellan personnel must inspect the tank farm (including tanks and containment) for
the integrity of the containment dikes or secondary containment, evidence of product
releases, trash and debris, uncontrolled erosion, unusual sounds from operating
equipment, damage, vibration, misalignment, and security;
c. Continuous monitoring of the special permit tank levels through the supervisory
control and data acquisition (SCADA) system; and
Semi-annual, not to exceed 7 ½ months, static tank trending for 12 continuous hours
to verify the integrity of the special permit tanks. Magellan must isolate the special
permit tanks from inbound or outbound products movements. The special permit
tank level must be at least half full. Once isolated, the breakout storage tank must sit
idle for a minimum of 12 continuous hours. During the static 12 hours, the special
permit tank product level must be reviewed for product level discrepancies.
3. Re-evaluation Inspection Intervals: Magellan must develop procedures and conduct
transitional staged internal inspections of the special permit tanks and must readjust
inspection schedules of future special permit tank inspections as follows:
a. Inspection schedules of future special permit tank inspections must be based upon
past inspection findings at a special permit tank site location or similar vintage
construction types at other tank locations in this proposed special permit;
b. Re-evaluation intervals must be shortened when special permit tank inspection
findings demonstrate inspection intervals were not sufficiently conservative to
maintain established minimum safe floor and wall thicknesses, and material corrosion
rates;
Transitional staged internal special permit tank inspection intervals must be modified
if a breakout storage tank of similar service indicates a more conservative internal
inspection interval should apply; and

d. Special permit tanks of similar service must be identified by having been constructed
during, or within six (6) months of, the same year, under the same conditions, with
similar foundations and store similar products.
4. Annual Report to PHMSA: Annually,' after issuance of this special permit, Magellan
must submit an annual special permit tank integrity report'° to the PHMSA Central,
Eastern, Southwest and Western Region Directors with copies to the Deputy Associate

Director, PHIMSA Standards and Rulemaking Division.! The annual integrity report
must summarize for the special permit tanks the following and any other significant
integrity threats as follows:
a. Any leakage of special permit tanks including location, leakage amount, repairs
taken, and impact of any other tanks inspection schedule or integrity;
b. Any inspection findings that caused a readjustment of inspection schedules and the
special permit tanks involved in the reschedule of inspection interval;
c. Any secondary containment integrity issues found or remediated that would have
impacted containment in the case of a leak or failure of the special permit tank;
d. Any leaks or failures found through the continuous monitoring of tank levels through
the SCADA system (Condition 2.c) or the semi-annual static tank trending for 12
continuous hours (Condition 2.d); and
e. Identification of special permit tanks inspected during the past year and planned
inspections for the next two (2) years.
• Annual reports must be received by PHMSA by the last day of the month in which the special permit is
dated. For example, the annual report for a special permit dated January 2018, must be received by
PHMSA no later than January 31, each year beginning in 2019.

5. Tank Integrity Program: Under the proposed special permit, Magellan must continue
use of its existing documented Tank Integrity Program (Magellan procedure 7.10-ADM-
001 Tank Integrity Program, revision date 01/01/18)12 during the transitional staged
internal special permit tank inspection period (Condition 1).
6. Certification: A Magellan senior executive officer, vice president or higher must certify
in writing the following:
a. Magellan has developed a written manual of operating and maintenance (O&M)
procedures required by 49 CFR 195.402 and 195.432, and all requirements of this
special permit for the special permit tanks; and
b. Magellan has implemented all special permit conditions, 49 CFR 195.402 and
195.432, as required by this special permit for the special permit tanks.
Magellan must send the certifications required in Condition 6.a and 6.b with
completion date, compliance documentation summary, and the required senior
executive signature and date of signature to the PHMSA Associate Administrator for
Pipeline Safety with copies to the Deputy Associate Administrator, PHMSA Field
Operations; Deputy Associate Administrator, PHMSA Policy and Programs; PHMSA
Central, Eastern, Southwest, and Western Region Directors; Director, PHMSA
Standards and Rulemaking Division; Director, PHMSA Engineering and Research
Division'; and to the Federal Register Docket (PHMSA-2016-0072) at
www.Regulations.gov within one (1) year of the effective date of this special permit.

• Alternative 3: Modified Preferred Alternative
Alternatives Considered but Eliminated:
Based on the extensive history of safely managing over 800 breakout tanks through the
use of Magellan's existing documented and rigorous Tank Integrity Program, an
alternative considered but eliminated was a permanent special permit that would have
proposed that Magellan's program that was allowed by 49 CFR 195.432 prior to the
January 5, 2015 rulemaking regarding "Periodic Update of Regulatory References to
Technical Standards and Miscellaneous Amendments". This alternative was eliminated
in favor of the transitional staged breakout tank internal inspection schedule (Alternative
2 above) to ultimately achieve full and sustained compliance with the amended 49 CFR
195.432.
V.
Affected Resources and Environmental Consequences
The environmental resources and issues listed here evaluate the potential for significant
effect in comparison to the "no action" alternative. These resources are required to be
analyzed by federal laws, regulations, executive orders, and departmental policy.
Aesthetics:
The special permit request will not change the visual character/aesthetics since the
atmospheric aboveground breakout storage tanks included in the special permit
request are pre-existing and are located inside Magellan's current storage tank
facilities.
Agricultural Resources
The special permit is unlikely to impact agricultural resources. The atmospheric
aboveground breakout storage tanks included in the special permit request are
pre-existing and are located inside Magellan's current storage tank facilities.
Approval of the special permit request will allow for the uninterrupted supply of
refined fuels needed for farming and agricultural needs. Should the special permit
not be approved, supply interruption of refined fuels needed for farming and
agriculture will occur when atmospheric aboveground storage tanks are removed

amended regulations included in 49 CFR 195.432.
The purpose of the shorter inspection intervals required in 49 CFR 195.432(b) is
to better ensure the integrity of breakout tanks based upon API 653 criteria.
Failure of breakout tanks can be caused by defects caused by corrosion or
cracking, which more frequent inspections are intended to prevent. Therefore, it
is possible that maintaining the superseded longer interval period would slightly
increase the risk of failure than if the applicant was in full compliance with the
current requirements of 49 CFR 195.432(b). However, the conditions attached to
the proposed special permit, such as added visual inspections of the break out
tanks and their secondary containment dikes, continuous monitoring of tank levels
through the SCADA system, semi-annual static tank trending for 12 continuous
hours, annual reporting, and increased oversight by PHMSA, exceed current
requirements in 49 CFR Part 195, and are intended to further reduce the
likelihood of a release. Also, the vast majority of the tanks included in the
proposed special permit have containment dikes, which are not required by 49
CFR Part 195 and would prevent the release of hazardous liquids to the
environment, including surrounding farmland. A breakout tank leak or failure
could seriously damage or impact agricultural land if the hazardous liquids
reached it.
Air Quality
The special permit request will have no impact on air quality since the
atmospheric aboveground breakout storage tanks are pre-existing and are located
inside Magellan's current storage tank facilities. Air emissions related to
operation of the existing atmospheric aboveground breakout storage tanks are
authorized as required by the appropriate state air quality rules. The special
permit request impacts the timing of out-of-service inspections to be completed
but does not significantly increase or decrease the amount of activity conducted
during the out-of-service inspections. As a result, any impact the special permit

request might have on air quality would be an improvement based on the impact
associated with the frequency that opening, degassing, and cleaning tanks can
have on short term increased emissions. There is no new construction or
expansion of existing facilities associated with this special permit request.
4.
Biological Resources
The purpose of the shorter inspection intervals required in 49 CFR 195.432(b) is
to better ensure the integrity of breakout tanks based upon API 653 criteria.
Failure of breakout tanks can be caused by defects caused by corrosion or
cracking, which more frequent inspections are intended to prevent. Therefore, it
is possible that maintaining the superseded longer interval period would slightly
increase the risk of failure than if the applicant was in full compliance with the
current requirements of 49 CFR 195.432(b). However, the conditions attached to
the proposed special permit, such as added visual inspections of the break out
tanks and their secondary containment dikes, continuous monitoring of tank levels
through the SCADA system, semi-annual static tank trending for 12 continuous
hours, annual reporting and increased oversight by PHMSA, exceed current

resources if the hazardous liquids reached them.
PHMSA expects that the special permit is unlikely to impact biological resources.
The atmospheric aboveground breakout storage tanks are pre-existing and are
located inside Magellan's current storage tank facilities. These facilities would be
considered industrial land inside maintained facilities consisting of existing roads,
storage tanks, buildings, pump stations, valves, facility piping, and other
aboveground appurtenances. Magellan facilities include maintained grass
vegetation, cement foundations, cement and asphalt roads, and gravel pads.

Climate Change
The special permit request will have no impact on global climate change since the
atmospheric aboveground breakout storage tanks are pre-existing.
Cultural Resources
The special permit request will have no impact on cultural, archaeological, or
paleontological resources since the atmospheric aboveground breakout storage
tanks are pre-existing and are located inside Magellan's current storage tank
facilities. Under the special permit request, the frequency of potential ground
disturbing activities conducted during internal tank inspections will be less
frequent until Magellan achieves compliance with the revision to 49 CFR 195.432
using a transitional staged internal inspection schedule.
7.
Environmental Justice
The special permit request will have no disparate impact on low-income, minority
or non-English language populations since the atmospheric aboveground breakout
storage tanks are pre-existing and are located inside Magellan's current storage
tank facilities.
Geology, Soils, and Mineral Resources
While the issuance of this special permit could result in a small increase in the
likelihood of release of hazardous liquid, PHMSA believes that the risk is remote.
A release of hazardous liquids could impact soils near a tank farm. The special
permit request does not include the construction of new facilities that impacts a
disturbance of the soils. Existing Magellan facilities include maintained grass
vegetation, cement foundations, asphalt and cement roads, and gravel pads that
mitigate the potential for erosion to occur. The atmospheric aboveground
breakout storage tanks included in the special permit request are within secondary
containment areas consisting of compacted native soils, compacted native soils
with clay amendments, or an engineered material such as pavement or concrete.
The extensive history of operating the existing Magellan atmospheric
aboveground breakout storage tanks facilities does not include incidence or

susceptibility to landslides. Atmospheric aboveground breakout storage tanks
built to API 650 include the consideration of seismic activity in the design and
construction of the storage tanks.
Indian Trust Assets
The special permit request will have no impact on Indian Trust Assets since the
atmospheric aboveground breakout storage tanks are pre-existing and are located
inside Magellan's current storage tank facilities, therefore no Tribal coordination
has occurred.
10.
Land Use
The special permit request will have no impact on the land use since the
atmospheric aboveground breakout storage tanks are pre-existing and are located
inside Magellan's current storage tank facilities. The land use category would be
described as industrial property consisting of storage tanks, buildings, pump
stations, valves, facility pipe, roads, and other aboveground appurtenances.
However, lands directly outside Magellan's facilities are used for commercial,
industrial, residential, and recreational purposes. These lands have the remote
possibility of facing impacts in the event of a tank failure. If granted, the special
permit request will not require permits from local government.
11.
Noise
The special permit request will have no impact on the noise levels since the
atmospheric aboveground breakout storage tanks are pre-existing and are located
inside Magellan's current storage tank facilities. The special permit request does
not impact the day-to-day operations of the assets, only the timing associated with
out-of-service inspections. The special permit will not impact the noise level
during out-of-service inspections.
12.
Recreation
The special permit request is unlikely to impact recreational resources because the
atmospheric aboveground breakout storage tanks are pre-existing and are located

inside Magellan's current storage tank facilities. All Magellan storage tank
facilities are in secure fenced locations that are routinely maintained to prevent
unauthorized access. There are no recreational activities that occur within
Magellan facilities. There is a remote chance that a failure of a breakout tank
within a Magellan facility could negatively impact recreational resources.
13.
Safety
The purpose of the shorter inspection intervals required in 49 CFR 195.432(b) is
to better ensure the integrity of breakout tanks. Failure of breakout tanks can be
caused by defects caused by corrosion or cracking, which more frequent
inspections are intended to prevent. Therefore, it is possible that maintaining the
superseded longer interval period would slightly increase the risk of failure than if
the applicant was in full compliance with the current requirements of 49 CFR
195.432(b). A breakout tank leak and especially a failure could negatively impact
safety if hazardous liquids escaped containment dykes. Exposure to hazardous
liquids can cause health risks, and the hazardous liquid can ignite, causing
dangerous fires or explosion.
PHMSA expects that approval of the special permit will not significantly change
the risk of failure or impact safety due to the additional proposed special permit
conditions that exceed current requirements in Part 195, such as additional
external inspections. Magellan's proven and existing Tank Integrity Program has
contributed to a history of safely managing over 800 atmospheric aboveground
breakout storage tanks. During the staged transitional internal inspection
schedule Magellan will continue to utilize its Tank Integrity Program that
incorporated the required and consistent criteria used to establish tank internal
inspection intervals utilizing the provisions previously allowed per 49 CFR
195.432. This criterion was developed in consideration of API Standards 580,
581, and 653. The Magellan Tank Integrity Program performs initial inspections
at ten (10) year intervals to establish a corrosion rate using API 653 criteria. The
Magellan Tank Integrity Program then establishes subsequent inspection intervals

through the evaluation of an established minimum safe floor thickness, previous
inspection results, the corrosion rates, and defined likelihood and consequence
factors.
The consequence of a release and the risk of failure would not be impacted by
granting the special permit request. The atmospheric aboveground breakout
storage tanks are pre-existing and are located within secondary containment dikes
inside Magellan's current storage tank facilities.
Would operation under the special permit have an effect on pipeline
aboveground breakout tank longevity or reliability? Would there be any life
cycle or maintenance issues?
Due to longer internal inspection intervals, it is possible that corrosion or other
integrity issues could go undetected for a longer period of time under the special
permit, which could affect tank longevity or reliability. However, PHMSA
believes that this is a relatively small risk that is overcome by other monitoring
requirements in the special permit. Operation under a special permit will not have
a significant effect on the longevity or reliability of the atmospheric aboveground
breakout storage tanks. During the staged transitional internal inspection
schedule Magellan will continue to utilize its existing Tank Integrity Program for
the tanks listed in Attachments 1 through 4 that incorporates the criteria used to
establish tank internal inspection intervals utilizing the provisions previously
allowed per 49 CFR 195.432. The criteria were developed in consideration of
API Standards 580, 581, and 653.

Socioeconomics
The special permit request is unlikely to impact low income populations since the
atmospheric aboveground breakout storage tanks are pre-existing and are located
inside Magellan's current storage tank facilities.

Topography

Water Resources
The purpose of the shorter inspection intervals required in 49 CFR 195.432(b) is
to better ensure the integrity of breakout tanks. Failure of breakout tanks can be
caused by unrepaired defects caused by corrosion or cracking, which more
frequent inspections are intended to prevent. Therefore, it is possible that
maintaining the superseded longer interval period would slightly increase the risk
of failure than if the applicant was in full compliance with the current
requirements of 49 CFR 195.432(b). A breakout tank leak and especially a failure
could negatively impact water resources because hazardous liquid could enter
surface waters. Oil spills to surface waters can compromise water quality for
human consumption as drinking water, agricultural use, and habitat use.
However, the likelihood of such a failure is remote, and PHMSA expects that the
special permit request is unlikely to impact surface waters, wetlands, or drinking
water aquifers since the atmospheric aboveground breakout storage tanks are pre-
existing, are located inside Magellan's current storage tank facilities, and the
majority of tanks have containment dikes capable of holding the entire contents of
a tank.
The atmospheric aboveground breakout storage tanks are located within
existing and maintained secondary containment areas designed to prevent the
overland flow migration of product outside of the facility in the event of a spill.
There are no surface waters or wetlands within the engineered secondary

containment areas. The special permit request does not include any construction
or impact associated with clearing vegetation, soil compaction, trench excavation,

IX.
Finding of No Significant Impact
In consideration of the safety conditions explained above, PHMSA finds that no
significant negative impact will result from the issuance of the above-described special
permit with conditions to extend the inspection intervals of storage tanks on the Magellan
pipeline system. PHMSA believes that the issuance of the special permit, which includes
safety conditions that exceed current pipeline safety requirements in 49 CFR Part 195,
will have a positive impact on the human environment because implementation of the
permit would reduce the overall risk of failure that could result in serious harm to human
health. PHMSA finds that the issuance of the above described proposed special permit
would not result in a significant impact to safety and the human environment.

The Magellan above ground breakout storage tanks and associated facilities are at 81 locations in
14 states. These facilities are industrial properties consisting of storage tanks, buildings, pump
stations; valves, facility pipe, roads, and other above ground appurtenances.
Based on the determination in the Special Permit Analysis and Findings (available in the docket)
that this special permit, with conditions, will maintain pipeline safety, PHMSA OPS hereby
grants special permit PHMSA-2016-0072 as follows:
I. Special Permit Tanks:
493 tanks located in the States of Colorado, Connecticut, Illinois, Iowa, Kansas, Minnesota,
Missouri, Nebraska, North Dakota, Oklahoma, South Dakota, Texas, Wisconsin, and
Wyoming
On the condition that Magellan complies with the terms and conditions set forth below, this
special permit waives compliance from 49 CFR 195.432 for the inspection intervals of 493
existing atmospheric above ground breakout storage tank as described below and in Appendix A
- Magellan Breakout Storage Tanks: Location - State, Facility Name, County, and Number of
Tanks and Appendix B - Secondary Dike Containment of this special permit.
• Special permit tanks - are defined as any of the 493-existing atmospheric above ground
breakout storage tank described in Appendix A of this special permit.
PHMSA hereby grants this special permit for the Magellan special permit tanks based on the
findings set forth in the "Special Permit Analysis and Findings" and the "Final Environmental
Assessment and Findings of No Significant Impact documents, which both can be read in their
entirety in Docket No. PHMSA-2016-0072 in the Federal Docket Management System (FDMS)
located on the internet at www.Regulations.gov.
II. Conditions:
PHMSA OPS grants this special permit for the special permit tanks subject to implementation of
the following conditions:

1. Internal Inspection Schedule: For the atmospheric above ground breakout storage tanks
(special permit tanks), Magellan must conduct a transitional staged internal inspection
schedule as follows:
a. Special Permit Tanks Last Inspected Before 1995: Inspect within 30 years of the
previous internal inspection date (25 tanks remain to be inspected as of May 2017).
b. Special Permit Tanks Last Inspected Between 1995 and 2009: Inspect within 28
years of the previous internal inspection date (333 tanks remain to be inspected as of
May 2017).
c. Special Permit Tanks Last Inspected Between 2010 and 2013: Inspect within 25
years of the previous internal inspection date (135 tanks remain to be inspected as of
May 2017).
2. Special Permit Tank Inspections and Monitoring: Magellan must develop procedures,
conduct, document, and maintain:
Internal inspections of the described existing special permit tanks that are consistent
with the special permit and as required by 49 CFR 195.432,3,4
b. Visual inspections of the special permit tanks and their secondary containment dikes
are required once per manned shift and at least weekly for unmanned locations.
Magellan personnel must inspect the tank farm (including tanks and containment) for
the integrity of the containment dikes or secondary containment, evidence of product
releases, trash and debris, uncontrolled erosion, unusual sounds from operating
equipment, damage, vibration, misalignment, and security;

c. Continuous monitoring of the special permit tank levels through the supervisory
control and data acquisition (SCADA) system; and
d. Semi-annual, not to exceed 7 ½ months, static tank trending for 12 continuous hours
to verify the integrity of the special permit tanks. Magellan must isolate the special
permit tanks from inbound or outbound products movements. The special permit
tank level must be at least half full. Once isolated, the breakout storage tank must sit
idle for a minimum of 12 continuous hours. During the static 12 hours, the special
permit tank product level must be reviewed for product level discrepancies.
3. Re-evaluation Inspection Intervals: Magellan must develop procedures and conduct
transitional staged internal inspections of the special permit tanks and must readjust
inspection schedules of future special permit tank inspections as follows:
a. Inspection schedules of future special permit tank inspections must be based upon
past inspection findings at a special permit tank site location or similar vintage
construction types at other tank locations in this proposed special permit;
b. Re-evaluation intervals must be shortened when special permit tank inspection
findings demonstrate inspection intervals were not sufficiently conservative to
maintain established minimum safe floor and wall thicknesses, and material corrosion
rates;
c. Transitional staged internal special permit tank inspection intervals must be modified
if a breakout storage tank of similar service indicates a more conservative internal
inspection interval should apply; and
d. Special permit tanks of similar service must be identified by having been constructed
during, or within six (6) months of, the same year, under the same conditions, with
similar foundations and store similar products.

4. Annual Report to PHMSA: Annually, after issuance of this special permit, Magellan must
submit an annual special permit tank integrity report to the PHMSA Central, Eastern,
Southwest and Western Region Directors with copies to the Deputy Associate Administrator,
PHMSA Field Operations; Deputy Associate Administrator, PHMSA Policy and Programs;
Director, PHMSA Engineering and Research Division; and Director, PHMSA Standards and
Rulemaking Division.? The annual integrity report must summarize for the special permit
tanks the following and any other significant integrity threats as follows:
a. Any leakage of special permit tanks including location, leakage amount, repairs
taken, and impact of any other tanks inspection schedule or integrity;
b. Any inspection findings that caused a readjustment of inspection schedules and the
special permit tanks involved in the reschedule of inspection interval;
c. Any secondary containment integrity issues found or remediated that would have
impacted containment in the case of a leak or failure of the special permit tank;
d. Any leaks or failures found through the continuous monitoring of tank levels through
the SCADA system (Condition 2.c) or the semi-annual static tank trending for 12
continuous hours (Condition 2.d); and
e. Identification of special permit tanks inspected during the past year and planned
inspections for the next two (2) years.
5. Tank Integrity Program: Under the proposed special permit, Magellan must continue use
of its existing documented Tank Integrity Program (Magellan procedure 7.10-ADM-001 Tank

For example, the annual report for a special permit dated January 2018, must be received by PHMSA no later than
January 31, each year beginning in 2019.

6. Certification: A Magellan senior executive officer, vice president or higher must certify in
writing the following:
a. Magellan has developed a written manual of operating and maintenance (O&M)
procedures required by 49 CFR 195.402 and 195.432, and all requirements of this
special permit for the special permit tanks; and
b. Magellan has implemented all special permit conditions, 49 CFR 195.402 and
195.432, as required by this special permit for the special permit tanks.
Magellan must send the certifications required in Condition 6.a and 6.b with completion
date, compliance documentation summary, and the required senior executive signature and
date of signature to the PHMSA Associate Administrator for Pipeline Safety with copies to
the Deputy Associate Administrator, PHMSA Field Operations; Deputy Associate
Administrator, PHMSA Policy and Programs; PHMSA Central, Eastern, Southwest, and
Western Region Directors; Director, PHMSA Standards and Rulemaking Division; Director,
PHMSA Engineering and Research Division'; and to the Federal Register Docket (PHMSA-
2016-0072) at www.Regulations.gov within one (1) year of the effective date of this special
permit.
II. Limitations:
PHMSA issues this special permit subject to the following limitations:
1) PHMSA has the sole authority to make all determinations on whether Magellan has complied
with the specified conditions of this special permit.

2) Failure to submit the certifications required by Condition 6 within the time frames specified
may result in revocation of this special permit.
3) PHMSA may revoke, suspend, or modify this special permit based on any finding listed in 49
CFR 190.341(b)(1) and require Magellan to comply with the regulatory requirements in 49
CFR 195.432 and an amended Condition 1-Internal Inspection Schedule. As provided in 49
U.S.C. Chapter 601 and 49 CFR Part 190, PHMSA may also issue an enforcement action for
failure to comply with this special permit. Any work plans and associated schedules will be
automatically incorporated into this special permit and are enforceable in the same manner.
4) Should PHMSA revoke, suspend, or modify this special permit based on any finding listed in
49 CFR 190.341(h)(1), PHMSA will notify Magellan in writing of the proposed action and
provide Magellan an opportunity to show cause why the action should not be taken. In
accordance with 49 CFR 190.341(h)(2)(i), Magellan may provide a written response within
30 days of the notice showing why the proposed action should not be taken. However, if
necessary to avoid the risk of significant harm to persons, property, or the environment,
PHMSA will declare the proposed action (revocation, suspension, or modification)
immediately effective, in accordance with 49 CFR 190.341(h)(3).
5) The terms and conditions of any corrective action order, compliance order, or other order
applicable to a pipeline facility covered by this special permit will take precedence over the
terms of this special permit in accordance with 49 CFR 190.341(h)(4).
6) Magellan may seek reconsideration of a decision made pursuant to 49 CFR 190.341(h) by
submitting a petition to the Associate Administrator of Pipeline Safety, in accordance with 49
CFR 190.341(i). The Associate Administrator's decision made pursuant to 49 CFR
190.341(i) constitutes final administrative action. All final administrative actions are subject
to juridical review under 49 U.S.C. 60119.
7) If Magellan sells, merges, transfers, or otherwise disposes of the assets known as the special
permit tanks, Magellan must provide PHMSA with written notice of the change within 30
days of the consummation date. In the event of such transfer, PHMSA reserves the right to
revoke, suspend, or modify the special permit if the transfer constitutes a material change in

conditions or circumstances pursuant to 49 CFR 190.341(h)(1)(ii) or any other circumstances
listed under 49 CFR 190.341(b)(1).
8) PHMSA grants this special permit to a term of no more than 20 years from the issuance date.

PHMSA received approval from the Railroad Commission of Texas pipeline office, Director -
Stephanie Weidman on January 26, 2018 to include the Magellan intrastate hazardous pipeline facility
breakout tanks noted in Appendix B above as part of the special permit. Magellan intrastate hazardous
liquid pipeline facility breakout tanks in the state of Connecticut are inspected by PHMSA and are a part
of this special permit as noted in Appendix B above.
