These rules are applicable to all utilities except for certain provisions\nas defined in the rule.\n(b) For the purpose of the Customer Data Access and Privacy Rules, gas utilities are\nclassed into three tiers: a Tier I utility serves more than 150,000 gas customers;\na Tier II utility serves between 50,000 and 150,000 gas customers. A Tier III\nutility serves fewer than 50,000 gas customers.\n(c) No Tier III utility is required to:\n(I) include in its tariffs a description of standard and non-standard customer\ndata that the utility is able to provide to the customer or to any third party\nrecipient (see paragraph 4027(c));\n(II) provide customer notice each year regarding customer data (see rule\n4028);\n(III) make customer consent forms for the disclosure of customer data\navailable to customers or third parties (see rule 4029);\n(IV) disclose aggregated data (see rule 4033); or\n(V) provide a community energy report (see rule 4035).\nHowever, a Tier III utility may include a description of standard and non-standard\ncustomer data that the utility is able to provide to the customer or to any third-\nparty recipient in its tariffs (in accordance with paragraph 4027(c)). Commencing\nupon the effective date of such description, the Tier III utility shall be deemed to\nbe a Tier II utility for purposes of these Customer Data Access and Privacy Rules\nfor so long as such tariff provisions remain in effect.","truncated":false,"body_characters":1579}
