(b) An application filed in accordance with §§ 29-20-108, C.R.S., and this rule shall include, in the following order and specifically ","machine_formats":{"json":"https://regulus.evalyn.ai/document/co-ccr-4-723-4-4703.json","markdown":"https://regulus.evalyn.ai/document/co-ccr-4-723-4-4703.md"},"app_url":"https://regulus.evalyn.ai/document/co-ccr-4-723-4-4703","source_url":"https://www.sos.state.co.us/CCR/DisplayRule.do?action=ruleinfo&ruleId=2260&deptID=18&agencyID=96&deptName=Department%20of%20Regulatory%20Agencies&agencyName=Public%20Utilities%20Commission&seriesNum=4%20CCR%20723-4","body":"(a) To commence an appeal of a local government land use decision, a utility or\npower authority shall file with the Commission an application pursuant to this\nrule.\n(b) An application filed in accordance with §§ 29-20-108, C.R.S., and this rule shall\ninclude, in the following order and specifically identified, the following information,\neither in the application or in appropriately identified attachments:\n(I) all of information required in paragraphs 4002(b) and 4002(c);\n(II) a showing that one of the preconditions set out in rule 4702 has been met;\n(III) identification of the major natural gas facility;\n(IV) identification of the local government action and its impact on the major\nnatural gas facility;\n(V) a statement of the reasons the applying utility or power authority believes\nthat the local government action would unreasonably impair its ability to\nprovide safe, reliable, and economical service to the public;\n(VI) the demonstrated need for the major natural gas facility or reference to the\napplication made to the Commission with respect to the major natural gas\nfacility and the resulting decision of the Commission regarding such\nfacility;\n(VII) the extent to which the proposed facility is inconsistent with existing\napplicable local or regional land use ordinances, resolutions, or master or\ncomprehensive plans;\n(VIII) whether the proposed facility would exacerbate a natural hazard;\n(IX) applicable utility engineering standards, including supply adequacy,\nsystem reliability, and public safety standards;\n(X) the relative merit, as determined through use of the normal system\nplanning evaluation techniques of the utility or power authority, of any\nreasonably available and economically feasible alternatives proposed by\nthe utility, the power authority, or the local government;\n\n(XI) the impact that the local government action would have on the customers\nof the utility or power authority who reside within and without the\nboundaries of the jurisdiction of the local government;\n(XII) the basis for the local government action. If available, the utility or power\nauthority shall attach a copy of the local government action;\n(XIII) the impact the proposed facility would have on residents within the local\ngovernment's jurisdiction including, in the case of a right-of-way in which\nfacilities have been placed underground, whether those residents have\nalready paid to place such facilities underground. If the residents have\nalready paid to place facilities underground, the Commission will give\nstrong consideration to that fact;\n(XIV) information concerning how the proposed major natural gas facility will\naffect the safety of residents within and without the boundaries of the\njurisdiction of the local government; and\n(XV) an attestation that the utility or power authority will, upon filing the\napplication with the Commission, simultaneously send the application to\nthe local government body which took the local government action which\nis the subject of the appeal.","truncated":false,"body_characters":3004}
