(a) Payment of a penalty under this Subpart must be made by certified check or money order payable to the Department of Public Service and sent to the Secretary to the Commission, Three Empire State Plaza, Albany, NY 12223-1350.

(b) If a respondent fails to pay the full amount of a penalty assessed in a final order within 30 days after receipt of the final order, the commission may refer the case to the Attorney General with a request that an action to collect the assessed penalty be brought in any court of competent jurisdiction.
