The fatigue mitigation provisions in 49 CFR 192.631(d)(4) and 195.446(d)(4) allow emergency deviation from maximum controller hours-of-service when necessary for safe operation. Operators do not need to notify PHMSA solely because a controller exceeds hours-of-service, but must document the deviation. Additional fatigue risks must be addressed through the operator's fatigue mitigation program and available countermeasures should be used during extraordinary conditions.
