This Order incorporated the terms of a Consent\nAgreement signed by PHMSA and Columbia. The Consent Agreement resulted from a Notice of Proposed\nSafety Order (Notice) that was issued to Columbia alleging that conditions exist on the section of the\nMillennium pipeline running from Corning to Ramapo, New York that posed a pipeline integrity risk to\npublic safety, property or the environment. The Notice proposed that Columbia take certain measures with\nrespect to the Millennium pipeline to ensure pipeline safety.\nWe are in receipt of Mr. Hoffman’s letter dated, October 1, 2012, wherein he summarized the actions taken\nto comply with this Order. We have reviewed that letter and the documentation that he provided. Specifically, the Notice alleged that such conditions\ncaused a loss of system integrity and a natural gas leak that was discovered on January 11, 2011\nduring a routine inspection in Tioga County, New York.\nIn response to the Notice, Respondent requested an informal consultation. Respondent and\nPHMSA engaged in good-faith settlement discussions resulting in the Consent Agreement,\nattached to this Order, that settles all of the allegations in the Notice.\nAccordingly, the foregoing Consent Agreement and Operator Plan is hereby approved and\nincorporated by reference into this Order. The Respondent is hereby ordered to comply with the\nterms of the Consent Agreement, effective immediately.\nPursuant to 49 U.S.C. 60101 et seq. and 49 C.F.R § 190.221, failure to comply with this Consent\nOrder may result in the assessment of civil penalties of up to $100,000 per violation per day, or\nin the referral of the case for judicial enforcement.
