The items inspected and the\nprobable violations are:\n1. § 192.179 Transmission line valves.\n(b) Each sectionalizing block valve on a transmission line, other than offshore\nsegments, must comply with the following:\n(1) The valve and the operating device to open or close the valve must be readily\naccessible and protected from tampering and damage\nDuring the NYS DPS field inspections of Honeoye facilities on April 27, 2011, Honeoye valves\nnumbered A2 and A7 did not have any mechanism that would prevent tampering and/or damage\n(valves were not locked). During a re-inspection of those facilities by the NYS DPS\nrepresentatives the following week in early May 2011, both valves were observed to be secured\nwith a chain and lock.\n\n\n\nCPF 1-2012-0002W\nUnder 49 United States Code, § 60122, you are subject to a civil penalty not to exceed $100,000\nfor each violation for each day the violation persists up to a maximum of $1,000,000 for any We\nhave reviewed the circumstances and supporting documents involved in this case, and have\ndecided not to conduct additional enforcement action or penalty assessment proceedings at this\ntime. We advise you to correct the items identified in this letter. Failure to do so will result in\nHoneoye Storage Corporation being subject to additional enforcement action.\nNo reply to this letter is required. If you choose to reply, in your correspondence please refer to\nCPF 1-2012-0002W. Be advised that all material you submit in response to this enforcement\naction is subject to being made publicly available.
