Dear Mr. Kukosky:
From May 2-4, 2011, a representative of the Pipeline and Hazardous Materials Safety Administration
(PHMSA) pursuant to Chapter 601 of 49 United States Code conducted an on-site pipeline safety
inspection of PEI Power Corporation’s (PEI) procedures for the plastic transmission landfill pipelines
located in Archbald, PA. As a result of the inspection, PEI was issued a Notice of Amendment on July
17, 2012.
We received your follow-up letter dated September 17, 2012 along with attachments in response to the
Notice of Amendment.
As you are aware, Pennsylvania Legislature recently passed a law that expanded the Pennsylvania Public
Utility Commission authority to inspect and enforce intrastate transmission pipelines such as this pipeline.
The Pennsylvania Public Utility Commission has now assumed the responsibility for inspection and
enforcement of your pipeline system.
Accordingly, no further action is necessary in connection with this case. This case is now closed.
