As a result of the inspection, it appears that you have committed probable violations of the Pipeline Safety Regulations, Title 49, Code of Federal Regulations. The items inspected and the probable violation(s) are: 1. §192.455 External corrosion control: Buried or submerged pipelines installed after July 31, 1971. a) Except as provided in paragraphs (b), (c), and (f) of this section, each buried or submerged pipeline installed after July 31, 1971, must be protected against external corrosion, including the following: (2) It must have a cathodic protection system designed to protect the pipeline in accordance with this subpart, installed and placed in operation within 1 year after completion of construction. The City failed on one occasion to have a cathodic protection (CP) system, designed to protect its pipeline in accordance with this subpart, installed and placed in operation within 1 year after completion of construction on a buried pipeline installed after July 31, 1971. The City did not put a ¾” diameter coated steel service line under CP within one year after completion of construction as required by §192.455(a)(2). The service line located at 6100 Belmont Rd, Richmond, VA was installed in 1979. At the time of the VASCC inspection, there was no CP installed. Evidence is based on VA SCC Notice of Investigation (NOI) to the City, and City responses to the VA SCC NOI. We understand that the service line to 6100 Belmont Road was replaced on 08/31/2013 with plastic. 1-2015-0007W Under 49 United States Code, § 60122, you are subject to a civil penalty not to exceed $200,000 per violation per day the violation persists up to a maximum of $2,000,000 for a related series of violations. For violations occurring prior to January 4, 2012, the maximum penalty may not exceed $100,000 per violation per day, with a maximum penalty not to exceed $1,000,000 for a related series of violations. We have reviewed the circumstances and supporting documents involved in this case, and have decided not to conduct additional enforcement action or penalty assessment proceedings at this time. We advise you to correct the item(s) identified in this letter. Failure to do so will result in the City being subject to additional enforcement action. No reply to this letter is required.
