The items inspected and the probable violations are:\n1. §195.420 Valve maintenance\n(b) Each operator shall, at intervals not exceeding 7 ½ months, but at least twice each calendar year,\ninspect each mainline valve to determine that it is functioning properly.\nKiantone failed to conduct valve inspections at least twice each calendar year on their mainline for calendar\nyears 2012 and 2013.\nDuring the inspection, PHMSA and NYSDPS inspectors reviewed mainline valve inspection records for\n2012 and 2013. The inspection results were recorded by Kiantone on form 13.3.1 – Kiantone Block Valve\nInspection & Maintenance. The form lists nine valves (Valves #1-7, MS-1, and MOV 161) located in New\nYork, and five valves (Valves #8-11 and DV-1) located in Pennsylvania.\nIn calendar year 2012, the 14 identified mainline valves were only inspected once, in August.\nIn calendar year 2013, the 14 identified mainline valves were only inspected once, in September.\n\n\n\n1-2015-5004W\n2. §195.412 Inspection of rights-of-way and crossings under navigable waters.\na) Each operator shall, at intervals not exceeding 3 weeks, but at least 26 times each calendar year,\ninspect the surface conditions on or adjacent to each pipeline right-of-way. Methods of inspection\ninclude walking, driving, flying or other appropriate means of traversing the right-of-way.\nKiantone failed to inspect the surface conditions of the pipeline right-of-way at intervals not exceeding 3\nweeks, but at least 26 times each calendar year.\nDuring the inspection, PHMSA and NYSDPS inspectors reviewed Kiantone’s Annual Patrol Matrix from\n2011 through 2014. The matrix covers right-of-way patrolling of the pipelines from West Seneca, NY to\nWarren, PA.\nIn calendar year 2011, the right-of-way was patrolled aerially 23 times and once by walking patrol, for a total\nof 24 patrols.\nIn calendar year 2013, the right-of-way was patrolled aerially 24 times and once by walking patrol, for a total\nof 25 patrols.\nUnder 49 United States Code, § 60122, you are subject to a civil penalty not to exceed $200,000 per\nviolation per day the violation persists up to a maximum of $2,000,000 for a related series of violations. For\nviolations occurring prior to January 4, 2012, the maximum penalty may not exceed $100,000 per violation\nper day, with a maximum penalty not to exceed $1,000,000 for a related series of violations. We have\nreviewed the circumstances and supporting documents involved in this case, and have decided not to conduct\nadditional enforcement action or penalty assessment proceedings at this time. We advise you to correct the\nitems identified in this letter. Failure to do so will result in Kiantone being subject to additional enforcement\naction.\nNo reply to this letter is required.
