The\nNotice proposed finding that Respondent had violated 49 C.F.R. §195.444 and proposed certain\nmeasures to correct the violation. Respondent did not contest the Notice.\nBased upon a review of all of the evidence, pursuant to § 190.213, I find that Respondent\nviolated the pipeline safety regulation listed below, as more fully described in the enclosed\nNotice:\n49 C.F.R. §195.444 (Item 1) ─ Respondent failed to maintain records\ndocumenting that the field instrumentation used in its leak detection system were\ntested and calibrated pursuant to the requirements of Section 5.1.3 of API RP\n1130 (incorporated by reference in §195.3).\nThis finding of violation will be considered a prior offense in any subsequent enforcement action\ntaken against Respondent.\nRespondent has completed the actions proposed in the Notice to correct the violation.
