In accordance with 49 C.F.R. § 190.207, the Notice proposed finding\nthat Respondent committed one violation of 49 C.F.R. Part 195 and proposed certain measures to\ncorrect the violation. Ergon responded to the Notice by letter dated September 30, 2023,\nproviding additional information, but did not contest the allegation or corrective measures.\nRespondent did not request a hearing and therefore has waived its right to one.\nBased on a review of all of the evidence, pursuant to § 190.213, I find Respondent violated the\npipeline safety regulations listed below, as more fully described in the enclosed Notice, which is\nincorporated by reference:\n49 C.F.R. § 195.446 (a) (Item 1) ---Respondent failed to follow its written control room\nmanagement procedures. Specifically, Ergon failed to follow its Control Room\nManagement Plan, November 2014 (CRM Plan), Section 7.8 regarding monitoring the\ncontent and volume of general activity being directed to and required of each controller at\nleast once each calendar year, but at intervals not exceeding 15 months that will assure\ncontrollers have sufficient time to analyze and react to incoming alarms.\nThis finding of violation will be a considered prior offense in any subsequent enforcement action\ntaken against Respondent.\n\n\n\nCompliance Actions\nPursuant to 49 U.S.C. § 60118(b) and 49 C.F.R. § 190.217, Respondent is ordered to take the\nactions proposed in the enclosed Notice to correct the violation. The Director may grant an\nextension of time to comply with any of the required items upon a written request timely\nsubmitted by the Respondent and demonstrating good cause for an extension. Upon completion\nof the ordered actions, Respondent may request that the Director close the case. Failure to\ncomply with this Order may result in the assessment of civil penalties under 49 C.F.R. § 190.223\nor in referral to the Attorney General for appropriate relief in a district court of the United States.\nThe terms and conditions of this order are effective upon service in accordance with 49 C.F.R.\n§ 190.5.\nWarning Items\nWith respect to Items 2, 3, and 4, the Notice alleged probable violations of 49 C.F.R.\n§§ 195.446(a) and 192.605(j)(1) but did not propose a civil penalty or compliance order for these\nitems. Therefore, these are considered to be warning items. If OPS finds a violation any of these\nitems in a subsequent inspection, Respondent may be subject to future enforcement action.\nThe terms and conditions of this order are effective upon service in accordance with 49 C.F.R.\n§ 190.5.\nDecember 4, 2023\n___________________________________ _________________________\nAlan K.
