On July 12,\n2024, PHMSA issued to Respondent the Final Order. The Final Order included a Compliance\nOrder. On December 12, 2024, Respondent submitted to PHMSA the completed action items from\nthe Final Order, including revised procedures and a plan for performing an updated EFRD\nevaluation. PHMSA has reviewed these submittals and find that they satisfy the terms of the Final\nOrder.\nAccordingly, this case is now closed, and no further action is contemplated with respect to the\nmatters involved in this case. The Notice proposed finding that Respondent\nhad violated the pipeline safety regulations in 49 C.F.R. Part 195. The Notice also proposed\ncertain measures to correct the violation. Respondent did not contest the allegations of violation\nor corrective measures.\nBased upon a review of all of the evidence, pursuant to § 190.213, I find Respondent violated the\npipeline safety regulation listed below, as more fully described in the enclosed Notice, which is\nincorporated by reference:\n49 C.F.R. § 195.452(a)(i)(4) (Item 1) ─ Respondent failed to conduct an adequate\nEmergency Flow Restricting Device (EFRD) study to determine if one is needed\non a pipeline segment to protect a high consequence area in the event of a hazardous\nliquid release pursuant to the specific factors.\nThis finding of violation will be considered a prior offense in any subsequent enforcement action\ntaken against Respondent.\nCompliance Actions\nPursuant to 49 U.S.C. § 60118(b) and 49 C.F.R. § 190.217, Respondent is ordered to take the\nactions proposed in the enclosed Notice to correct the violation. The Director may grant an\nextension of time to comply with any of the required items upon a written request timely\nsubmitted by the Respondent and demonstrating good cause for an extension. Upon completion\nof the ordered actions, Respondent may request that the Director close the case.
