As a result of the inspection, the Director, Southern\nRegion, OPS, issuedto Respondent, byletter dated October 28, 2003, aNotice ofProbableViolation\nand Proposed Compliance Order(Notice). In accordance with 49 C.F.R. $ 190.207,the Notice\nproposed finding that Respondent had violated 49 C.F.R. Part195andproposed that Respondent\ntakecertain measuresto correct the alleged violations.\nRespondent responded to the Notice by letter dated March12,2004 (Response). Respondent did not\ncontest the allegations ofviolation but provided information concerning the corrective actionsit has\ntaken.Respondentdid not requesta hearing, consequently Respondent waivedits right to one.\nFINDINGS OFVIOLATION\nRespondent didnot contest the alleged violations.Accordingly, I find that Respondent violated the\nfollowing sections of Part195, as more fully described in the Notice:\n49 C.F.R. $ 195.555- failure to establishand maintain requirements veriffing the\nqualificationof supervisors responsible for corrosion controlproceduresin the O & M\nManual.\n49 C.F.R. $ 195.571 failure to require compliance\n- with applicable cathodic protection of\nNACERP0169-96 in the O & M Manual.\n49 C.F.R. $ 195.581(a)\n- failure to contain requirements in the O & M Manual forprotecting\nexposedpipelinesfromatrnospheric corrosion.\n49 C.F.R. $ 195.583(a) -failure to contain requirements formonitoring onshore atmospheric\ncorrosion in the O & M Manual.\n\n\n\n2\nThese findings ofviolation will be considered prioroffenses in any subsequent enforcement action\ntaken against Respondent.\nCOMPLIANCE ORDER\nThe Notice proposed a compliance order. Respondent has demonstratedcorrective action addressing\nthe items in the proposed compliance order. Respondent has incorporated the requirements ofitems\n|\n, 2, 3, and 4 of the Notice into its O & M Manual. Because Respondent's actionssatisfied the\nproposed compliance terms, no need exists to issue a compliance order.
