FINALORDER
On August 25-27,2003, pursuant of the Southem
to 49U.S.C. $ 60117, a representative Region,
Officeof Pipeline Safety (OPS),conducted an on-site inspection of Respondent's facilities and
records in Alabama at the Melvin Pump Station. As a result of the inspection, the Director, Southern
Region, OPS, issuedto Respondent, byletter dated October 28, 2003, aNotice ofProbableViolation
and Proposed Compliance Order(Notice). In accordance with 49 C.F.R. $ 190.207,the Notice
proposed finding that Respondent had violated 49 C.F.R. Part195andproposed that Respondent
takecertain measuresto correct the alleged violations.
Respondent responded to the Notice by letter dated March12,2004 (Response). Respondent did not
contest the allegations ofviolation but provided information concerning the corrective actionsit has
taken.Respondentdid not requesta hearing, consequently Respondent waivedits right to one.
FINDINGS OFVIOLATION
Respondent didnot contest the alleged violations.Accordingly, I find that Respondent violated the
following sections of Part195, as more fully described in the Notice:
49 C.F.R. $ 195.555- failure to establishand maintain requirements veriffing the
qualificationof supervisors responsible for corrosion controlproceduresin the O & M
Manual.
49 C.F.R. $ 195.571 failure to require compliance
- with applicable cathodic protection of
NACERP0169-96 in the O & M Manual.
49 C.F.R. $ 195.581(a)
- failure to contain requirements in the O & M Manual forprotecting
exposedpipelinesfromatrnospheric corrosion.
49 C.F.R. $ 195.583(a) -failure to contain requirements formonitoring onshore atmospheric
corrosion in the O & M Manual.

These findings ofviolation will be considered prioroffenses in any subsequent enforcement action
taken against Respondent.
COMPLIANCE ORDER
The Notice proposed a compliance order. Respondent has demonstratedcorrective action addressing
the items in the proposed compliance order. Respondent has incorporated the requirements ofitems

, 2, 3, and 4 of the Notice into its O & M Manual. Because Respondent's actionssatisfied the
proposed compliance terms, no need exists to issue a compliance order. The terms and conditions
ofthis FinalOrderare effective upon receipt.
