Arkansas 71730\ncPF 2-2007-6002W\nDear Mr. Warren:\nOn July I I -13, 2006, a representative of the Pipeline and Hazardous Materials Safety\nAdministration (PHMSA) pursuant to Chapter 601 of 49 United States Code inspected your\nIntegrity Management Program (IMP) in El Dorado, Arkansas.\nAs a result of the inspection, it appears that you have committed probable violations of Part 195\nPipeline Safety Regulations, Title 49, Code of Federal Regulations. The items inspected and\nthe probable violations are:\n1. $195.452(0 What are the elements of an integrity managem€nt program? (3) An\nanalysis that integrates all available information about the integrity of the entire\npipeline and the consequences ofa failure.\nLion Oil did not have documentation of the numbers used in its risk model for ranking\nthe pipeline segments in the baseline plan.\n2, $195.452(h) What actions must an operator take to address integrity issues? (l)\nGeneral requirements. An operator must take prompt action to address all\nanomalous conditions that the operator discovers through the integrity\nassessment or information analvsis.\nThe company performed an integrity assessment on a 7 mile segment of 10\" pipeline\nwhich was out of service and Iocated in Jefferson County, Texas. The segment is part\n\n\n\nof the Paline System operating in Texas. Records indicated that all anomalies known\nto be immediate, 60-day, and 180-day conditions as noted in the IMP rule were\nremoved. However, no dates were documented for discovery. This information would\nbe significant for future integrity assessment of the pipeline and consideration of\noperating service for the segment. The segment remains out of service and has never\noperated in service after it was purchased in 1989.\n3.\n§195.452(f)(8) What are the elements of an integrity management program? (8) A\nprocess for review of integrity assessment results and information analysis by a\nperson qualified to evaluate the results and information.\nThe company did not have documentation on the qualifications of individuals that\nreview and evaluate assessment results.\nUnder 49 United States Code, § 60122, you are subject to a civil penalty not to exceed\n$100,000 for each violation for each day the violations persists up to a maximum of $1,000,000\nfor any related series of violations. We have reviewed the circumstances and supporting\ndocuments involved in this case, and have decided not to conduct additional enforcement action\nor penalty assessment proceedings at this time. We advise you to correct the items) identified\nin this letter. Be advised that failure to do so will result in Lion Oil being subject to additional\nenforcement action.\nNo reply to this letter is required.
