Department\nof Transportation\nPipeline and\nHazardous Materials Safety\nAdministration\n233 Peachtree Street Ste. 600\nAtlanta, GA 30303\nWARNING LETTER\nCERTIFIED MAIL - RETURN RECEIPT RE UESTED\nSeptember 2, 2008\nMr, Jim Colliugsworth\nPresident\nDixie Pipeline Company\n1100 Louisiana Street\nHouston, Texas 77002-5227\nCPF 2-2008-5008W\nDear Mr. Collinsworth:\nOn July 7 to 11, 2008, a representative of the Pipeline and Hazardous Materials Safety\nAdministration (PHMSA) pursuant to Chapter 601 of 49 United States Code inspected your\nhydrostatic test of the Hattiesburg to Demopolis section of Dixie Pipeline Company's 12\"\npipeline in Alabama and Mississippi.\nAs a result of the inspection, it appears that you have committed a probable violation of the\nPipeline Safety Regulations, Title 49, Code of Federal Regulations. The item inspected and the\nprobable violation is:\nII195. 402 Procedural manual for operations, maintenance, and emergencies.\n(a) General. Each operator shall prepare and follow for each pipeline system a manual\nof written procedures for conducting normal operations and maintenance activities and\nhandling abnormal operations and emergeucies. This manual shall be reviewed at\nintervals not exceeding 15 months, but at least once each calendar year, and\nappropriate changes made as necessary to insure that the manual is effective. This\nmanual shall be prepared before initial operations of a pipeline system commence, and\nappropriate parts shall be kept at locations where operations and maintenance\nactivities are conducted.\nDuring the Dixie Pipeline Company (Dixie) Hattiesburg to Demopolis hydrostatic test, Dixie\ndid not have available backfill procedures during pipe replacement work for hydrostatic test\nfailures on July 8, 2008.\n\n\n\nA copy of the procedure for backfilling the pipeline was requested while observing repair\nwork on July 8, 2008 and one was not available on the site. On July 9, 2008 Dixie provided\na copy of Enterprise Products Operating L. P. Spec. LP-13, Construction Specifications For\nLand Pipeline Construction, Lowering-In d'i Backfilling. The Specification in Sections 2. 3\nSupports and 2. 5 Tie-ins require tie-ins to be supported by sandbags or other Company\napproved material at spacing intervals of 15 feet or less to provide stress-free support\nsubsequent to back-filling. The pipeline was not being supported per the specifications.\nWhen Dixie personnel were notified of this the PHMSA representative was advised that the\nSpecification was a new construction specification and did not apply as this was a\nmaintenance activity. Dixie subsequently provided a copy of Procedure MPR-4108 General\nLine cf Equip. Maint. Backfilling and Cleanup, from the prior Dixie Pipeline Company\nMaintenance Manual, as the procedure that was being used for the backfilling. The\nprocedure used is not referenced in the current Dixie Pipeline Company Procedures Manual\nFor Pipeline Operations, Maintenance, and Emergencies. The current Dixie Pipeline\nCompany Procedures Manual For Pipeline Operations, Maintenance, and Emergencies does\nnot address backfilling in Section 5. 5 Pipeline Repairs and Pipeline Movement nor address\nthe use of prior Dixie procedures.\nUnder 49 United States Code, I'1 60122, you are subject to a civil penalty not to exceed $100, 000\nfor each violation for each day the violation persists up to a maximum of $1, 000, 000 for any\nrelated series of violations. We have reviewed the circumstances and supporting documents\ninvolved in this case, and have decided not to conduct additional enforcement action or penalty\nassessment proceedings at this time. We advise you to correct the item identified in this letter.\nFailure to do so will result in Dixie pipeline Company being subject to additional enforcement\naction.\nNo reply to this letter is required. If you choose to reply, in your correspondence please refer to\nCPF 2-2008-5008W. Be advised that all material you submit in response to this enforcement\naction is subject to being made publicly available.
