Box 1273\nCharleston, WV 25314 CPF 2-2009-1005W\nDear Mr. Gaglio:\nOn July 13-17, 2009, representatives of the Southern Region, Pipeline and Hazardous Materials\nSafety Administration (PHMSA) pursuant to Chapter 601 of 49 United States Code, conducted\nan inspection of your pipeline facilities and reviewed records at your Winchester, Kentucky\noffice.\nAs a result of the inspection, it appears that you have committed a probable violation of the\nPipeline Safety Regulations, Title 49, Code of Federal Regulations. The item inspected and the\nprobable violation is:\n192.705 Transmission lines: Patrolling.\n(a) Each operator shall have a patrol program to observe surface conditions on and\nadjacent to the transmission line right-of-way for indications of leaks, construction\nactivity, and other factors affecting safety and operation.\nThe field inspection of three pipeline right-of-way in the Winchester area on Line F\ndownstream of the Foster Station, Line G and Line KA-1 downstream of the Clays Ferry\nBridge location found the need for adequate cutting in observing factors affecting safety\nand operation.\n\n\n\nUnder 49 United States Code, § 60122, you are subject to a civil penalty not to exceed $100,000\nfor each violation for each day the violation persists up to a maximum of $1,000,000 for any\nrelated series of violations. We have reviewed the circumstances and supporting documents\ninvolved in this case, and have decided not to conduct additional enforcement action or penalty\nassessment proceedings at this time. We advise you to correct the item identified in this letter.\nFailure to do so will result in Columbia Gas Transmission being subject to additional\nenforcement action.\nNo reply to this letter is required. If you choose to reply, in your correspondence please refer to\nCPF 2-2009-1005W.
