Box 70\n2900 Opry House Road\nIva, SC 29655\nCPF 2-2011-1002M\nDear Mr. Thorndyke:\nOn October 20-21, 2010, representatives of the Pipeline and Hazardous Materials Safety\nAdministration (PHMSA) inspected the Santee Cooper - Rainey (SCR) Generating Station\nprocedures for Operations and Maintenance (O&M) in Iva, South Carolina, pursuant to\nChapter 601 of 49 United States Code.\nOn the basis of the inspection, PHMSA has identified the apparent inadequacy found within\nSCR’s procedures, as described below:\n§192.605 Procedural manual for operations, maintenance, and emergencies.\n…. (b) Maintenance and normal operations. The manual required by paragraph (a)\nof this section must include procedures for the following, if applicable, to provide\nsafety during maintenance and operations.\n…. (9) Taking adequate precautions in excavated trenches to protect personnel from\nthe hazards of unsafe accumulations of vapor or gas, and making available when\nneeded at the excavation, emergency rescue equipment, including a breathing\napparatus and, a rescue harness and line.\n\n\n\nSantee Cooper’s O&M procedures were inadequate because they did not include taking\nadequate precautions in excavated trenches to protect personnel from the hazards of unsafe\naccumulations of vapor or gas, and making available when needed at the excavation,\nemergency rescue equipment, including a breathing apparatus and, a rescue harness and line.\nAt the time of the inspection, SCR personnel explained that this requirement was addressed in\nthe company’s APPA Safety Manual, Section 907 and Confine Space Entry Manual.\nHowever, these manuals were not referenced in the O&M manual.\nResponse to this Notice\nThis Notice is provided pursuant to 49 U.S.C. § 60108(a) and 49 C.F.R. § 190.237. Enclosed\nas part of this Notice is a document entitled Response Options for Pipeline Operators in\nCompliance Proceedings. Please refer to this document and note the response options. Be\nadvised that all material you submit in response to this enforcement action is subject to being\nmade publicly available. If you believe that any portion of your responsive material qualifies\nfor confidential treatment under 5 U.S.C. 552(b), along with the complete original document\nyou must provide a second copy of the document with the portions you believe qualify for\nconfidential treatment redacted and an explanation of why you believe the redacted\ninformation qualifies for confidential treatment under 5 U.S.C. 552(b). If you do not respond\nwithin 30 days of receipt of this Notice, this constitutes a waiver of your right to contest the\nallegations in this Notice and authorizes the Associate Administrator for Pipeline Safety to\nfind facts as alleged in this Notice without further notice to you and to issue a Final Order.\nIf, after opportunity for a hearing, your plans or procedures are found inadequate as alleged in\nthis Notice, you may be ordered to amend your plans or procedures to correct the\ninadequacies (49 C.F.R. § 190.237). If you are not contesting this Notice, we propose that\nyou submit your amended procedures to my office within 45 days of receipt of this Notice.\nThis period may be extended by written request for good cause. As a result\nof the inspection, PHMSA issued a Notice of Amendment (NOA) on January 13, 2011.\nThis letter is to inform you that Santee Cooper – Rainey (SCR) Generating Station has\ncomplied with the terms of the NOA. No further action is necessary with regards to the NOA\nand this case is now closed.\nPlease be advised that this letter refers only to the NOA (re: CPF 2-2011-1002M) and not to\nany other PHMSA pending cases. Also be advised that nothing herein states or implies that\nthe above described O&M meets the requirements of the federal pipeline safety regulations or\nthat the O&M is approved.
