The Notice proposed finding that Respondent had violated the\npipeline safety regulations in 49 C.F.R. Part 195 and proposed certain measures to correct the\nviolations. Respondent did not contest the allegations of violation or corrective measures.\nBased upon a review of all of the evidence, pursuant to § 190.213, I find Respondent violated the\npipeline safety regulations listed below, as more fully described in the enclosed Notice, which is\nincorporated by reference:\n49 C.F.R. § 195.440(b) (Item 1) ─ Respondent failed to follow the general\nprogram recommendations of API RP 1162 and assess the unique attributes and\ncharacteristics of its Port Everglades Beeline pipeline.\nThis finding of violation will be considered a prior offense in any subsequent enforcement action\ntaken against Respondent.\nThe Director has indicated that Respondent completed the actions proposed in the Notice to\ncorrect the violations. Therefore, it is not necessary to include the proposed compliance terms in\nthis Final Order.\nWARNING ITEM\nWith respect to Item 2, the Notice alleged a probable violation of 49 C.F.R. § 195.452(i)(3), but\ndid not propose a civil penalty or compliance order for this item. Therefore, this is considered to\nbe a warning item. If OPS finds a violation of this provision in a subsequent inspection,\nRespondent may be subject to future enforcement action.\nThe terms and conditions of this order are effective upon service in accordance with 49 C.F.R.\n\n\n\nCPF 2-2019-6001\nPage 2\n§ 190.5.\nApril 24, 2020\n___________________________________ _________________________\nAlan K.
