The Notice proposed finding\nthat Respondent had violated a pipeline safety regulation in 49 C.F.R. Part 192. The Notice also\nproposed certain measures to correct the violation. Respondent did not contest the allegation of\nviolation or corrective measures.\nBased upon a review of all of the evidence, pursuant to § 190.213, I find Respondent violated the\npipeline safety regulation listed below, as more fully described in the enclosed Notice, which is\nincorporated by reference:\n49 C.F.R. § 192.631(d)(1) (Item 1) ─ Respondent failed to establish shift lengths\nand schedule rotations that provide controllers off-duty time sufficient to achieve\neight hours of continuous sleep, in order to reduce the risk associated with\ncontroller fatigue that could inhibit a controller's ability to carry out the roles and\nresponsibilities the operator has defined.\nThis finding of violation will be considered a prior offense in any subsequent enforcement action\ntaken against Respondent.\nCompliance Actions\nPursuant to 49 U.S.C. § 60118(b) and 49 C.F.R. § 190.217, Respondent is ordered to take the\nactions proposed in the enclosed Notice to correct the violation. The Director may grant an\nextension of time to comply with any of the required items upon a written request timely\nsubmitted by the Respondent and demonstrating good cause for an extension. Upon completion\n\n\n\nCPF No. 2-2021-002-NOPV\nPage 2\nof ordered actions, Respondent may request that the Director close the case. TGP is a subsidiary of Kinder Morgan (KM). As a result of the inspection, TGP was\nissued a Notice of Probable Violation and Proposed Compliance Order on May 26, 2021 and a\nFinal Order on August 12, 2021.\nTGP submitted its response and amended procedures on October 13, 2021.
