(Respondent). The Notice proposed finding that\nRespondent had violated the pipeline safety regulations in 49 C.F.R. Part 1991 and proposed a\ncivil penalty of $41,600. Respondent did not contest the allegations of violation or the proposed\ncivil penalty and paid the proposed civil penalty in full on January 19, 2024.\nBased upon a review of all of the evidence, pursuant to § 190.213, I find Respondent violated the\npipeline safety regulations listed below, as more fully described in the enclosed Notice, which is\nincorporated by reference:\n49 C.F.R. § 40.25(a) (Item 1) ─ Respondent failed to obtain the information listed\nin § 40.25(b) about employees seeking to begin performing safety-sensitive duties\nfor the first time in calendar year 2022; and\n49 C.F.R. § 199.105(e) (Item 2) ─ Respondent incorrectly conducted DOT return-\nto-duty drug tests of two covered employees for the presence of a prohibited drug\nwhen these employees had not refused to take a drug test and did not have a\npositive drug test result and were required to take and pass a DOT pre-employment\ndrug test before returning to perform covered functions.\nThese findings of violation will be considered prior offenses in any subsequent enforcement\naction taken against Respondent. In accordance with 49 C.F.R. § 190.223, Respondent is\nassessed the proposed civil penalty amount of $41,600, which Respondent has already paid in\nfull.\n1 In accordance with 49 C.F.R. § 199.5, violations of the DOT Procedures in 49 C.F.R. Part 40 regarding anti-drug\nand alcohol programs required by 49 C.F.R. Part 199 are considered violations of Part 199.\n\n\n\nWarning Item\nWith respect to Item 3, the Notice alleged a probable violation of 49 C.F.R. § 199.119(f) but did\nnot propose a civil penalty or compliance order for this Item. Therefore, this is considered to be a\nwarning item.
