The Notice proposed finding that Respondent had violated the\npipeline safety regulations in 49 C.F.R. Part 199 and proposed a civil penalty of $ 68,400. The\nNotice also proposed certain measures to correct the violations.\nRespondent did not contest the allegations of violation or corrective measures and paid the\nproposed civil penalty on October 2, 2024. In accordance with § 190.208(a)(1), such payment\nauthorizes the entry of this final order.\nBased upon a review of all of the evidence, pursuant to § 190.213, I find Respondent violated the\npipeline safety regulations listed below, as more fully described in the enclosed Notice, which is\nincorporated by reference:\n49 C.F.R. § 199.101 (Item 1) ─ Respondent failed to maintain and follow a\nwritten anti-drug plan that conforms to the requirements of Part 199 and the DOT\nProcedures.\n49 C.F.R. § 199.113 (Item 2) ─ Respondent failed to include, in its training for\nsupervisory personnel, a one 60-minute period of training on the specific,\ncontemporaneous physical, behavioral, and performance indicators of probable\ndrug use.\n49 C.F.R. § 199.202 (Item 3) ─ Respondent failed to maintain a written alcohol\nmisuse plan that conforms to the requirements of Part 199 and the DOT\nProcedures concerning alcohol testing programs.\n\n\n\n49 C.F.R. § 199.239 (Item 4) ─ Respondent failed to provide educational\nmaterials that explain the alcohol misuse requirements and its policies and\nprocedures with respect to meeting those requirements and did not distribute these\nmaterials to each covered employee prior to start of alcohol testing.\n49 C.F.R. § 199.241 (Item 5) ─ Respondent failed to ensure that persons\ndesignated to determine whether reasonable suspicion exists to require a covered\nemployee to undergo alcohol testing.\n49 C.F.R. § 40.13 (Item 6) ─ Respondent failed to differentiate its PHMSA D&A\n“covered employees” as defined in §199.3 from its non-DOT employees and\nconducted drug tests on individuals who were not DOT-regulated employees.\n49 C.F.R. § 40.25 (Item 7) ─ Respondent failed to obtain an employee’s written\nconsent and request the information listed in paragraphs (b) through (j) of § 40.25\nregarding employees seeking to begin performing safety-sensitive duties.\nThese findings of violation will be considered prior offenses in any subsequent enforcement\naction taken against Respondent. In accordance with 49 C.F.R. § 190.223, Respondent is\nassessed the proposed civil penalty amount of $68,400, which Respondent has already paid in\nfull.\nCompliance Actions\nPursuant to 49 U.S.C. § 60118(b) and 49 C.F.R. § 190.217, Respondent is ordered to take the\nactions proposed in the enclosed Notice to correct the violations. The Director may grant an\nextension of time to comply with any of the required items upon a written request timely\nsubmitted by the Respondent and demonstrating good cause for an extension. Upon completion\nof the ordered actions, Respondent may request that the Director close the case.
