The Notice proposed assessing a civil penalty of $5,000 for certain alleged\nviolations of 49 C.F.R . Part 192. Respondent responded to the Notice by letter dated lanuary 28,\n2004 @esponse). Respondent offered information to explain the allegations, but did not contest\npayment of the proposed civil penalty. Respondent submitted a check in the amount ofthe proposed\ncivil penalty ($5,000), waiving further right to respond, and authori zingthe entry of this Final Order.\nPursuant to g 190.209(aX1) and 49 U.S.C. g 60122,I find that Respondent violated the following\nsections of 49 C.F.R.Part 192 as described more completely in the Notice:\n49 C.F.R. S 192.751- faiting to take steps to minimize the accidental ignition of gas in an\narea where the presence of gas constituted afitehazard; and\n49 C.F.R. $ 192.605(a) - failing to ensure that contractor personnel followed Respondent's\nwritten procedures for the transferring of production water.\nThese findings of violation will be considered prior offenses in any subsequent enforcemen t action\ntaken againsi Respondent.
