The items inspected and\nthe probable violations are:\n1. S195.404 Maps and Records.\n(b) Each operator shall maintain for at least 3 years daily operating records that\nindicate-\n(f) The discharge pressure at each pump station;\nKinder Morgan did not have discharge pr€ssure records for Eldridge Pump Station for the\ncomplete 24 hour period on October 31,2003. Also, there were no discharge pressure\nrecords for Walnut Pump Station on October 27,2003.\n\n\n\n2. $195.420 Valve maintenance.\n(b) Each operator shall, at intervals not exceeding 7 1/2 months, but at least twice\neach calendar year, inspect each mainline valve to deterrnine that it is\nfunctioning properly.\nOn the KSM 103 Line within Bushton Pump Station, the KSM l0l/103 bypass valve, SIN\nM335790-9, was installed in July 2004. This valve is operated weekly dwing normal\noperations, but the valve did not receive Ihe2\"\" 2004 mainline valve inspection, and was\nnot inspected in 2005.\nUnder49UnitedStatesCode, S60l22,youaresubjecttoacivilpenaltynottoexceed$100,000\nfor each violation for each day the violations persists up to a maximum of $1,000,000 for any\nrelated series of violations. We have reviewed the circumstances and supporting documents\ninvolved in this case, and have decided not to conduct additional enforcement action or penalty\nassessment proceedings at this time. We advise you to correct the items identified in this letter.\nFailure to do so will result in Kinder Morgan Energy Partners, L.P. being subject to additional\nenforcement action.\nNo reply to this letter is required.
