Broker\nVP Westem Operations\nMid-Valley Pipeline\nBldg A/L3\nI Flour Daniels Drive\nSugar Land, Texas77478\nCPF No. 3-2007-5013W\nDear Mr. Broker:\nOn August 2l-24,2006, a representative of the Pipeline and Hazardous Materials Safety\nAdministration, Central Region, pursuant to Chapter 601 of 49 United States Code,\nconducted an on-site pipeline safety inspection of Mid-Valley Pipeline's (MVPL) records\nin Hebron, Kentucky and at facilities across the states of Ohio and Michigan.\nAs a result of the inspection, it appears that you have committed probable violations of the\nPipeline Safety Regulations, Title 49, Code of Federal Regulations. The items inspected\nand the probable violations are:\n1. $195.4f 0 Line markers.\n(c) Each operator shall provide line markiug at locations where the line is above\nground in areas that are accessible to the public.\n\n\n\nMVPL did not have a line marker on the Miami South main line block valve located\non the Hebron to Pyrmont pipeline section.\n2. $195.583 What must I do to monitor atmospheric corrosion control?\n(b) During inspections you must give particular attention to pipe at soil-to-air\ninterfaces, under thermal insulation, under disbonded coatings, at pipe supports,\nin splash zones, at deck penetrations, and in spans oyer water.\nMVPL did not inspect for atmospheric corrosion under thermal insulation on the\ndensitometer piping at the Sun Refinery Terminal in Toledo, Ohio.\nUnder 49 United States Code, S 60122, you are subject to a civil penalty not to exceed\n$100,000 for each violation for each day the violation persists up to a maximum of\n$ 1,000,000 for any related series of violations. We have reviewed the circumstances and\nsupporting documents involved in this case, and have decided not to conduct additional\nenforcement action or penalty assessment proceedings at this time. We advise you to\nconect the item idenlified in this letter. Failure to do so will result in MVPL being subject\nto additional enforcement action.\nNo reply to this letter is required. If you choose to reply, in your correspondence please\nrefer to CPF 3-2007-5013W .
