Kinder Morgan, a\nsubsidiary of Kinder Morgan Energy Partners, L.P., operates a 9.3-mile pipeline that transports\njet fuel from a terminal in Argo, Illinois, to a terminal at Chicago’s Midway Airport.\nRespondent also operates facilities in Oregon, New Jersey, and Texas.\nAs a result of the inspection, the Director, Central Region, OPS, issued to Respondent, by letter\ndated November 26, 2008, a Notice of Probable Violation and Proposed Civil Penalty (Notice).\nIn accordance with 49 C.F.R. § 190.207, the Notice proposed finding that Kinder Morgan had\ncommitted two violations of 49 C.F.R. § 195.404 and proposed assessing a civil penalty of\n$17,600 for the alleged violations.\nKinder Morgan responded to the Notice by letter dated December 9, 2008 (Response). The\ncompany did not contest the allegations of violation and paid the proposed civil penalty of\n$17,600, as provided in 49 C.F.R. § 190.227. Payment of the penalty serves to close the case\nwith prejudice to Respondent.\nFINDINGS OF VIOLATION\nIn its Response, Kinder Morgan did not contest the allegations in the Notice that it violated 49\nC.F.R. Part 195, as follows:\nItem 1: The Notice alleged that Respondent violated 49 C.F.R. § 195.404, which states in\nrelevant part:\n\n\n\n2\n§ 195.404 Maps and records.\n(a) . . . .\n(c) . . . .\n(3) A record of each inspection and test required by this subpart shall\nbe maintained for at least 2 years or until the next inspection or test is\nperformed, whichever is longer.\nItem 1(a) of the Notice alleged that Respondent violated 49 C.F.R. § 195.404(c)(3) by failing to\nmaintain records of required monthly inspections of five breakout tanks for November 2006 and\nAugust 2007.\nItem 1(b) of the Notice alleged that Kinder Morgan violated 49 C.F.R. § 195.404(c)(3) by failing\nto maintain records of required spring 2007 inspections of five mainline valves.\nRespondent did not contest these allegations of violation. Accordingly, based upon a review of\nall of the evidence, I find that Respondent violated 49 C.F.R. § 195.404(c) by failing to maintain\ninspection records as further described in the Notice.\nHaving reviewed the record and considered the assessment criteria, I assess Respondent a civil\npenalty of $17,600, which amount has already been paid by Respondent.\nThe terms and conditions of this Final Order are effective upon service in accordance with 49\nC.F.R. § 190.5.\n___________________________________ __________________________\nJeffrey D.
