The Notice proposed finding that Paradigm Energy Partner’s subsidiary,\nParadigm Midstream, LLC, (Respondent) had violated the pipeline safety regulations in\n49 C.F.R. Parts 194 and 195, and proposed a civil penalty of $59,000. Respondent did not\ncontest the allegations of violation or the proposed civil penalty.\nBased upon a review of all of the evidence, pursuant to § 190.213, I find Respondent violated the\npipeline safety regulations listed below, as more fully described in the enclosed Notice, which is\nincorporated by reference:\n49 C.F.R. § 194.7(b) (Item 1) ─ Respondent failed to operate its onshore pipeline\nfacilities in accordance with the applicable response plan. Specifically,\nRespondent failed to conduct the required National Preparedness for Response\nExercise Program (PREP) drills and equivalent to PREP, in accordance with its\nSpill Response Plan, in 2015 and 2016.\n49 C.F.R. § 195.402(c)(12) (Item 2) ─ Respondent failed to have written\nprocedures for establishing and maintaining liaison with fire, police, and other\nappropriate public officials.\n49 C.F.R. § 195.403(b)(1) (Item 3) ─ Respondent failed to review with personnel\ntheir performance in meeting the objectives of the emergency response training\nprogram at intervals not exceeding 15 months, but at least once each calendar\nyear.\nThese findings of violation will be considered prior offenses in any subsequent enforcement\naction taken against Respondent. In accordance with 49 C.F.R. § 190.223, Respondent is\n\n\n\nCPF 3-2019-6008\nPage 2\nassessed a civil penalty amount of $59,000.\nPayment of the civil penalty must be made within 20 days of service. Federal regulations (49\nC.F.R. § 89.21(b)(3)) require such payment to be made by wire transfer through the Federal\nReserve Communications System (Fedwire), to the account of the U.S. Treasury. Detailed\ninstructions are contained in the enclosure. Pursuant to\nthose same authorities, a late penalty charge of six percent (6%) per annum will be charged if\npayment is not made within 110 days of service.
