The Notice proposed finding that Respondent had violated the pipeline safety\nregulations in 49 C.F.R. Part 195 and proposed a civil penalty of $19,000. Respondent did not\ncontest the allegations of violation and paid the proposed civil penalty on November 9, 2020.\nBased upon a review of all of the evidence, pursuant to § 190.213, I find Respondent violated the\npipeline safety regulation listed below, as more fully described in the enclosed Notice, which is\nincorporated by reference:\n49 C.F.R. § 195.64 (Item 2) ─ Respondent failed to obtain an Operator\nIdentification Number from PHMSA until five years after its pipeline system had\nbeen in operation.\nThis finding of violation will be a considered a prior offense in any subsequent enforcement\naction taken against Respondent. In accordance with 49 C.F.R. § 190.223, Respondent is\nassessed the proposed civil penalty amount of $19,000, which Respondent has already paid in\nfull.\nWARNING ITEMS\nWith respect to Items 1 and 3, the Notice alleged probable violations of 49 C.F.R. §§ 195.49 and\n195.402, respectively, but did not propose a civil penalty or compliance order for these\n1 The PHMSA Operator Identification Number identifies the operator as Agrium US, Inc.
