(Respondent). The Notice proposed finding that Respondent had violated the\npipeline safety regulations in 49 C.F.R. Part 194 and Part 195 and proposed a civil penalty of\n$95,100. Savage Services Corporation, on behalf of Respondent, replied to the Notice and did\nnot contest the allegations of violation or the proposed civil penalty.\nBased upon a review of all of the evidence, pursuant to § 190.213, I find Respondent violated the\npipeline safety regulations listed below, as more fully described in the enclosed Notice, which is\nincorporated by reference:\n49 C.F.R. § 194.117(b)(1) (Item 1) ─ Respondent failed to maintain at its\nheadquarters a training record for each individual that has been trained as required\nby § 194.117 and assigned duties under the response plan;\n49 C.F.R. § 195.61(b) (Item 2) ─ Respondent failed to submit annually, on or\nbefore June 15, required geospatial data for its facilities as of December 31 of the\nprevious year;\n49 C.F.R. § 195.404(b)(1) (Item 3) ─ Respondent failed to maintain, for at least 3\nyears, daily operating records that indicated the discharge pressure at each pump\nstation; and\n49 C.F.R. § 195.589(c) (Item 4) ─ Respondent failed to maintain a record of each\nanalysis, check, demonstration, examination, inspection, investigation, review,\nsurvey, and test required by Part 195, Subpart H, in sufficient detail to\ndemonstrate the adequacy of corrosion control measures, or that corrosion\nrequiring control measures does not exist, for the requisite time periods.\n\n\n\nCPF No. 3-2021-015-NOPV\nPage 2\nThese findings of violation will be considered prior offenses in any subsequent enforcement\naction taken against Respondent. In accordance with 49 C.F.R. § 190.223, Respondent is\nassessed a civil penalty amount of $95,100.\nPayment of the civil penalty must be made within 20 days of service. Federal regulations (49\nC.F.R. § 89.21(b)(3)) require such payment to be made by wire transfer through the Federal\nReserve Communications System (Fedwire), to the account of the U.S. Treasury. Detailed\ninstructions are contained in the enclosure. Pursuant to\nthose same authorities, a late penalty charge of six percent (6%) per annum will be charged if\npayment is not made within 110 days of service.
