The Notice proposed finding that\nRespondent had violated the pipeline safety regulations in 49 C.F.R. Part 195. The Notice also\nproposed certain measures to correct the violations. Respondent did not contest the allegations\nof violation or corrective measures, and submitted information regarding how it is addressing the\nproposed corrective measures. Respondent paid the proposed civil penalty on December 6,\n2022.\nBased upon a review of all of the evidence, pursuant to § 190.213, I find Respondent violated the\npipeline safety regulation listed below, as more fully described in the enclosed Notice, which is\nincorporated by reference:\n49 C.F.R. § 195.452(b) (Item 1) – Respondent failed to follow its integrity management\nprocedure by not estimating the extent of dispersion of hazardous materials that could\nresult from a failure at Alexander Station and Alexander Junction facilities in Alexander,\nNorth Dakota.\n49 C.F.R. § 195.563(a) (Item 3) ─ Respondent failed to demonstrate that it had a\nfunctional cathodic protection system installed in its buried pipeline at the Alexander\nStation and Alexander Junction facilities within one year of operation.\n49 C.F.R. § 195.573(a)(1) (Item 4) ─ Respondent failed to conduct cathodic protection test\nas required on its mainline pipeline and breakout tanks in 2019 at its Alexander Station\nfacility.\n49 C.F.R. § 195.573(c) (Item 5) ─ Respondent failed to check the proper performance of\nan electrical bond located in its Alexander Junction facility.\n\n\n\n49 C.F.R. § 195.579(b)(2) (Item 6) ─ Respondent failed to monitor the effectiveness of\ninternal corrosion control measures in a segment of pipeline at its Alexander Station facility.\nThese findings of violation will be considered prior offenses in any subsequent enforcement\naction taken against Respondent. In accordance with 49 C.F.R. § 190.223, Respondent is\nassessed the proposed civil penalty amount of $132,100, which Respondent has already paid in\nfull.\nCompliance Actions\nPursuant to 49 U.S.C. § 60118(b) and 49 C.F.R. § 190.217, Respondent is ordered to take the\nactions proposed in the enclosed Notice to correct the violations. The Director may grant an\nextension of time to comply with any of the required items upon a written request timely\nsubmitted by the Respondent and demonstrating good cause for an extension. Upon completion\nof the ordered actions, Respondent may request that the Director close the case. Failure to\ncomply with this Order may result in the assessment of civil penalties under 49 C.F.R. § 190.223\nor in referral to the Attorney General for appropriate relief in a district court of the United States.\nWarning Item\nWith respect to Item 2, the Notice alleged a probable violation of 49 C.F.R. § 195.507 but did\nnot propose a civil penalty or compliance order for this item. Therefore, this is considered to be\na warning item.
