Part 195. The Notice also proposed certain measures to correct the\nviolation. Respondent did not contest the allegation of violation or corrective measures, but\nrequested additional time to complete the corrective measures.\nBased upon a review of all of the evidence, pursuant to § 190.213, I find Respondent violated the\npipeline safety regulation listed below, as more fully described in the enclosed Notice, which is\nincorporated by reference:\n49 C.F.R. § 195.446(a) (Item 1) ─ Respondent failed to implement required\nprocedures addressing the communication of abnormal operating conditions when\na different controller assumes responsibility.\nThis finding of violation will be considered a prior offense in any subsequent enforcement action\ntaken against Respondent.\nCompliance Actions\nPursuant to 49 U.S.C. § 60118(b) and 49 C.F.R. § 190.217, Respondent is ordered to take the\nactions proposed in the enclosed Notice to correct the violation. Respondent requested until\nNovember 1, 2024, to complete the corrective measures. Finding good cause, the request is\napproved. The corrective measures must be completed by December 1, 2024. The Director may\ngrant an additional extension of time to comply with any of the required items upon a written\n1 PHMSA’s 2023 inspection informing the Notice was of Alliance’s Control Room Management (CRM) procedures\nand records. Prior to the issuance of the Notice, on April 1, 2024, Pembina Pipeline Corporation acquired Alliance.\n\n\n\nrequest timely submitted by the Respondent and demonstrating good cause for an extension.\nUpon completion of the ordered actions, Respondent may request that the Director close the\ncase.
