The Notice proposed assessing a civil penalty of $ 1 0,000 for the alleged violation of\n49 C.F.R. g 195.440. Respondent responded by letter dated Septemb er 23, 2002 and did not contest\nthe allegation or the amount ofthe proposed civil penalty. Respondent submitted a wire transfer in the\namount of the proposed civil penalty ($10,000), waiving further right to respond, and authorizing the\nentry of this Final Order.\npursuant to g 190.209(a)(1) and 49 U.S.C. 5 60122,I find that Respondent violated the following\nsection of 49 C.F.R.
