The Notice proposed tinding that Respondent violated\n49 C.F.R. 45 195.401@) and 195.573(a)+ and proposed assessing a civil penalty of $1 1,500 for\nthe alleged violations. Respondent responded to the Notice by submitting a wire transfer in the\namount of the proposed civil penalty ($1 1,500). waiving M e r right to respond and authorizing\nthc entry of this Final Order.\nThe comsion control monitoring requirement cited in the Notice at 6 195.416(a) is now found\nat 9 195.573(a).I\nPursuant to 49 C.F.R. 4 190.213 and 49 U.S.C. 5 60122, I find that Respondent violated the\nfollowing sections of 49 C.F.R. Part 195, as more fblly described in the Notice:\n49 C.F.R. 4 195.401(b) - failing to correct within a reasonable time cathodic protection\nreadings less negative than the -0.850V criteria set by Respondent; and\n49 C.F.R. 5 195.573(a) - failing to conduct tests during the 1998 calendar year at several\ntest locations to determine the adequacy of cathodic protection.\nThese findings of violation will be considered prior offenses in any subsequent enforcement\naction taken against Respondent. I assess Respondent a civil penalty of $1 1,500, already paid by\nRespondent.
