As a result of the inspection, the Director,\nSouthwest Region, OPS, issued to Respondent, by letter dated October 15, 2004, a Notice of\nProbable Violation and Proposed Compliance Order (Notice). In accordance with 49 C.F.R.\n$ 190.207, the Notice proposed finding that Respondent had committed a violation of 49 C.F.R.\n{ 195.581 and proposed that Respondent take certain measures to correct the alleged violation.\nRespondent responded to the Notice by letter dated November 11, 2004 (Response). Respondent\ndid not contest the allegation of violation and provided information conceming the corrective\nactions it has taken. Respondent did not request a hearing, and therefore has waived its right to\none.\nFINDING OF VIOLATION\nIn its Response, Respondent did not contest the violation alleged in the Notice. Accordingly, I find\nthat Respondent violated the following section of 49 C.F.R. Part 195, as more fully described in\nthe Notice:\n49 C.F.R. $ 195.581 - failing to provide adequate coating to prevent atmospheric corrosion\non portions of pipeline exposed to the atmosphere at the Archer Valve site and the Ryan\nBooster Station.\nThis fincling oi vioiatioi-r w iii be considercd a pi-ior o!-lense in any subsequent etrforcemen{ action\ntaken aeainst Respondent.\n\n\n\nCOMPLIANCE ORDER\nThe Notice proposed a compliance order with respect to the violation of 49 C.F.R. $ 195.581\nIJnder 49 U.S.C. $ 601 l8(a), each person who engages in the transporlation of hazardous liquids or\nwho owns or operates a pipeline facility is required to comply with the applicable safety standards\nestablished under Chapter 601, The Director, Southwest Region, OPS has indicated that\nRespondent has taken the following actions specified in the Proposed Compliance Order:\nRespondent has cleaned and coated the necessary porlions of pipe at the Archer Valve site\nand the motor-operated valve at the Ryan Booster Station in accordance with\n49 C.F.R. $ 195.581.\nAccordingly, since compliance has been achieved with respect to this violation, it is not necessary\nto include the compliance terus in this Order.\nThe terms and conditions of this Final Order are effective on receipt.\n€,\"1\"Qw.\nStacey Gerard\nAssociate Administrator\nfor Pipeline Safety\nFEB 1 6 2005\nDate Issued","truncated":false,"body_characters":4104}
