The Notice proposed\nfinding that Respondent had violated the pipeline safety regulations in 49 C.F.R. Part 195 and\nproposed a civil penalty of $236,602. Respondent did not contest the allegations of violation and\npaid the proposed civil penalty on April 23, 2020. In accordance with § 190.208(a)(1), such\npayment authorizes the entry of this Final Order.\nBased upon a review of all of the evidence, pursuant to § 190.213, I find Respondent violated the\npipeline safety regulations listed below, as more fully described in the enclosed Notice, which is\nincorporated by reference:\n49 C.F.R. § 195.402(d) (Item 1) ─ Respondent failed to follow its manual of written\nprocedures for responding to, investigating, and correcting the cause of an increase\nin pressure or flow rate outside normal operating limits.\n49 C.F.R. § 195.505(d) (Item 2) ─ Respondent failed to follow its written\nqualification program and evaluate individuals when the operator had reason to\nbelieve the individuals’ performance of a covered task contributed to an accident as\ndefined by Part 195.\nThese findings of violation will be considered prior offenses in any subsequent enforcement action\ntaken against Respondent. In accordance with 49 C.F.R. § 190.223, Respondent is assessed the\nproposed civil penalty amount of $236,602, which Respondent has already paid in full.\nThe terms and conditions of this order are effective upon service in accordance with 49 C.F.R.\n§ 190.5.\nMay 7, 2020\n___________________________________ _________________________\nAlan K.
