The Notice proposed finding that Respondent had violated\nthe pipeline safety regulations in 49 C.F.R. Part 192. The Notice also proposed certain measures\nto correct the violations. Enable Midstream Partners, LP, on behalf of Respondent, replied to the\nNotice and did not contest the allegations of violation or corrective measures.\nBased upon a review of all of the evidence, pursuant to § 190.213, I find Respondent violated the\npipeline safety regulations listed below, as more fully described in the enclosed Notice, which is\nincorporated by reference:\n49 C.F.R. § 192.481(c) (Item 1) ─ Respondent failed to provide protection\nagainst atmospheric corrosion found during inspections as required by § 192.479.\n49 C.F.R. § 192.739(a) (Item 2) ─ Respondent failed to inspect and test each\npressure limiting station, relief device (except rupture discs), and pressure\nregulating station and its equipment at intervals not exceeding 15 months, but at\nleast once each calendar year.\n49 C.F.R. § 192.619(a) (Item 3) ─ Respondent failed to operate a segment of steel\nor plastic pipeline at a pressure that did not exceed a maximum allowable\noperating pressure determined under paragraph (c), (d), or (e) of this section, or the\nlowest of the alternatives presented by subparts (1) through (4) of § 192.619(a).\nThese findings of violation will be considered prior offenses in any subsequent enforcement\naction taken against Respondent.\n\n\n\nCPF No. 4-2021-001-NOPV\nPage 2\nCOMPLIANCE ACTIONS\nPursuant to 49 U.S.C. § 60118(b) and 49 C.F.R. § 190.217, Respondent is ordered to take the\nactions proposed in the enclosed Notice to correct the violations. The Director may grant an\nextension of time to comply with any of the required items upon a written request timely\nsubmitted by the Respondent and demonstrating good cause for an extension. Upon completion\nof ordered actions, Respondent may request that the Director close the case. As a\nresult of the inspection, Enable was issued a Final Order (Order) in the above-referenced case.\nThis Order included a Compliance Order.\nBased on PHMSA’s review of the documentation provided by Enable, it has been determined that\nEnable has complied with the terms of the Final Order.\nAccordingly, this case is now closed, and no further action is contemplated with respect to the\nmatters involved in this case.
