The Notice proposed finding that Respondent had violated the\npipeline safety regulations in 49 C.F.R. Part 192. The Notice also proposed certain measures to\ncorrect the violations. Genesis Energy, L.P., on behalf of Respondent, responded to the Notice\nand did not contest the allegations of violation or the proposed corrective measures.\nBased upon a review of all of the evidence, pursuant to § 190.213, I find Respondent violated the\npipeline safety regulations listed below, as more fully described in the enclosed Notice, which is\nincorporated by reference:\n49 C.F.R. § 192.605(a) (Item 1) ─ Respondent failed to prepare and follow a\nwritten operations and maintenance manual as required by § 192.605(a).\n49 C.F.R. § 192.615(a) (Item 2) ─ Respondent failed to establish written\nprocedures to minimize the hazard resulting from a gas pipeline emergency that\ncontains the elements described in § 192.615.\n49 C.F.R. § 192.805(a) (Item 3) ─ Respondent failed to develop and follow a\nwritten qualification program that included the provisions required by § 192.805.\n49 C.F.R. § 192.907(a) (Item 4) ─ Respondent failed to develop and follow a\nwritten integrity management program that contains the elements described in\n§ 192.911 for its covered pipeline segments.\nThese findings of violation will be considered prior offenses in any subsequent enforcement\naction taken against Respondent.\n\n\n\nCPF No. 4-2021-027-NOPV\nPage 2\nCOMPLIANCE ACTIONS\nPursuant to 49 U.S.C. § 60118(b) and 49 C.F.R. § 190.217, Respondent is ordered to take the\nactions proposed in the enclosed Notice to correct the violations. The Director may grant an\nextension of time to comply with any of the required items upon a written request timely\nsubmitted by the Respondent and demonstrating good cause for an extension. Upon completion\nof ordered actions, Respondent may request that the Director close the case. As a result of the inspection, PHMSA issued a Final Order on November\n3, 2021.\nPHMSA staff reviewed the responses and submitted documentation to demonstrate compliance\nwith the Compliance Oder and determined that Delfin has complied with the terms of the Final\nOrder.\nThis letter is to inform you no further action is necessary, and this case is now closed.
