The Notice proposed finding that Respondent had violated the\npipeline safety regulations in 49 C.F.R. Part 193 and proposed certain measures to correct the\nviolation. Respondent did not contest the allegation of violation or corrective measures.\nBased upon a review of all of the evidence, pursuant to § 190.213, I find Respondent violated the\npipeline safety regulation listed below, as more fully described in the enclosed Notice, which is\nincorporated by reference:\n49 C.F.R. § 193.2509(b)(4) (Item 1) ─ Respondent failed to develop and follow a\nwritten emergency procedure that provided for cooperating with local officials in\nevacuations and emergencies requiring mutual assistance.\nThis finding of violation will be considered a prior offense in any subsequent enforcement action\ntaken against Respondent.\nThe Director has indicated that Respondent completed the actions proposed in the Notice to\ncorrect the violation. Therefore, it is not necessary to include the proposed compliance terms in\nthis Final Order.\nThe terms and conditions of this order are effective upon service in accordance with 49 C.F.R.\n§ 190.5.\nOctober 25, 2021\n___________________________________ _________________________\nAlan K.
